We're Heading for a Recount in PA...and the Dems Want Illegal Ballots Counted.

Sen. Bob Casey (D-PA) has no path to victory. He’s going to lose to Republican Dave McCormick. Everyone, including Democrats, knows Casey lost. Yet, Casey refuses to concede because attorney Marc Elias is trying to steal the election. Those aren’t my words—The Wall Street Journal editorial board said as much about this fiasco occurring in the Keystone State.

“The Associated Press and most other media have called the Senate race in Pennsylvania for Republican Dave McCormick. But never fear, Democrats, lawyer Marc Elias is on the case trying to steal the seat for incumbent Democrat Bob Casey,” they wrote. “Did someone say ‘election denial’?”

Regardless, this contest is going to an unnecessary recount (via CBS News):

Does anyone know if Thune and the senate republicans can refuse to seat the new senators from WI, MI, NV, AZ and PA until audits are done of those elections.? We all know there’s shenanigans going on.

Totally agree. “Illegal” implies that the ballots were cast in a criminal manner. And I don’t think that’s the case.

But then again, nothing would surprise me anymore.

This is so predictable. They kept counting provisional ballots, including 16,000 that mysteriously showed up in blue areas until the gap became less than .5% then declared a recount.

There are still tons of red area provisional votes to be counted, maybe enough to get the margin above .5% but the recount has already been ordered.

I don’t believe the goal is to sneak in 40,000 more votes for Casey. I believe the goal is to use recounts, lawsuits, and delays to keep McCormick from being seated before senate votes are taken.

Chucky has some dirty tricks up his sleeve.

Supremacy clause. Federal law supersedes state law on matters that are under federal jurisdiction. If PA law is unclear, the federal case is even stronger.
I don’t think that the Dems would like this matter resolved at SCOTUS because then it’s is quite possible that they could rule that non-citizens can’t vote for anything despite state laws that may allow it.

Concession can affect outcomes.

Like so.

If ballot curing is going on by one’s own team, and a decision is made to concede, then uncured ballots don’t become cured ballots and don’t get counted and they may have been sufficient in number to win.

Or the Elias procedure underway will not get funded because of concession, and that procedure might have been successful.

Ordinarily, the count of ballots is not affected by concession, but the situations I just outlined are affected by concession and can affect the final count.

Ari Fleischer had great insight into this issue.
He suggests that the whole point is to build a legal precident going forward that people who aren’t registered should be allowed to vote.

Of course there is always the fund raising aspect but future cheating is the ulterior motive.

No, a ‘concession’ is simply a gracious formality. Democrats are never ‘gracious’...................

Something has to happen sadly. Better us gen-x deal with it than kick the can down the road. Clearly you can see we can’t coexist. Bloodless if very fortunate would just be some states and provinces breaking off and forming up.
