Generally, a firearm may not lawfully be sold by a licensee to a nonlicensee who resides in a state other than the state in which the seller’s licensed premises is located. However, the sale may be made if the firearm is shipped to a licensee whose business is in the purchaser’s state of residence and the purchaser takes delivery of the firearm from the licensee in his or her state of residence.

In addition, a licensee may sell a rifle or shotgun to a person who is not a resident of the state where the licensee’s business premises is located in an over–the–counter transaction, provided the transaction complies with state law in the state where the licensee is located and in the state where the purchaser resides.

And the 7.62×39mm essentially a sniper round. A properly zeroed/sighted in SKS/AK is a very effective long range weapon.

licensee == FFL

Like I said, transfers between states can be done through an FFL in each state. I’ve done it a number of times. I’ve not tried an OTC purchase of a rifle in another state though.

Please read the second paragraph carefully. It clearly states that an FFL holder may sell a rifle or a shotgun to a person who is not a resident of the State in which the FFL does business.

I’ve not tried an OTC purchase of a rifle in another state though.

That's a personal problem. It is a lawful thing to do, as stated by the BATFE themselves.

So you know that purchasing a rifle or shotgun from an FFL, "out of State", over the counter, is a lawful act. Yes, you can go across the border to Arizona and buy a rifle. You can drive to Virginia and buy a rifle. No need to involve any FFL other than the one you're buying from.

You don't have to take my word for it: I'm quoting the BATFE directly.

I'm sick of false "information" being bandied about by people who "authoritatively" reveal that they don't know what they're talking about. This stuff is easy to look up.

I guess you are right. Never thought about all the out of staters at the gun shows having to do that. I’ve bought on line and did that very thing. But assumed that by filing out the form and doing the check you could buy anywhere. Thanks for the heads up.

I believe the bag of ceramic tiles is to act as a bullet barrier. Think poor man’s bullet proof vest, but with the ability to put the bag up in a way to hide behind it as well.

The wouldbe assassin looks like the sort familiar with the ubiquitous lowlifes who traffic dope, “washed” guns, computers, etc., for cash. He seems to have had some money.

He could buy a stolen gun pre-washed or have the seller grind off the numbers, or do it himself (though he looks too wild-eyed to have the patience). Rquires some, but not incredible, knowledge and tools (Dremel tool or similat clone). Grinding/filing is not foolproof. The FBI lab might be able to recover metallurgical distortions deeper in the grain of forged steel. If they wanted to.

Lots of questions like how did this guy get an AK in the first place?

He may have had it in his possession for years. I have firearms that are decades old.

How did he get it from Hawai’i to Florida?

How do you know he brought it from Hawaii to Florida?

With the serial number filed off, he could have purchased it anytime and anywhere while he has been here rather than in Hawaii.....
