Georgia Judge Allows Challenge to Dominion Voting Machines to Continue

A long-standing lawsuit over the reliability and security of Georgia’s elections system will go to trial in January.

The case was filed by voters who want hand-marked paper ballots to replace the existing system of machines sold to the state by Dominion Voting Systems, although as noted by the Associated Press, it began three years before the allegations over Dominion’s machines that became part of the contentious aftermath of the 2020 presidential election.

On Nov. 10, U.S. District Judge Amy Totenberg issued a ruling rejecting the state’s position that no trial was necessary. The ruling called for the state and its critics to try to resolve their differences without a trial.

“The Court cannot wave a magic wand in this case to address the varied challenges to our democracy and election system in recent years, including those presented in this case,” she wrote.

“But reasonable, timely discussion and compromise in this case, coupled with prompt, informed legislative action, might certainly make a difference that benefits the parties and the public,” she wrote.

But that seems unlikely.

“The court’s order makes it clear that Georgia’s status quo is far too risky, and that these concerning issues merit a trial. We look forward to prevailing at trial as we demonstrate why touchscreen BMDs (ballot-marking devices) cannot be used safely,” said Marilyn Marks, executive director for the Coalition for Good Governance, one plaintiff suing the state, according to the Atlanta Journal-Constitution.

David Cross, an attorney for some plaintiffs, said the court ruling noted “a long story of incompetence, conflicting claims, and misinformation.”

That is encouraging language, but it definitely is not the stand that most judges take/took. Particularly back in 2020, most judges wouldn’t take any cases related to the elections. They were cowards who didn’t want to appear to be intervening in elections, but probably understood full well that the nature of the complains meant that the elections were already compromised.

One would think that democrats would welcome ejudication of these challenges. To bring it out into the light, so that they can finally say “See! There was no fraud and there were no irregularities! It was proved in court”. But no, they just want to have it both ways. Call people fringe kooks put keep the evidence in the shadows

The judge keeps skipping over the Admission by GA in the case that their evidence of 147,000 ballots is 'lost / missing'. This is classic Brady Rule that causes the case to end, in this case for the voter plaintiff.

This judge is so far out in left field she can't even see the stadium. All she can, but won't legally do, is rule the 2020 election results from GA 'UNLAWFUL'. It's the state Legislature's problem, and Congress has a part, but not the judge.

having a jury, from an un-rigged pool of regular folks, is the key to all of these so called ‘trials.’ if there isn’t one, it’s a waste of time.

The machines are a red herring.

That’s not how it was done.

It happened by activists getting multiple ballots sent to unverified addresses. Then they filled them out and dropped them off VBM. No face or ID was seen.

There were hand counts that matched machine output. Dominion had nothing to do with it.

Yes. There are serious questions about what the machines were capable of doing, but that wasn’t the problem in this election.

Did you read the Judge’s ruling? I did. She was very clear that the Dominion machines were vulnerable to hacking and mentioned that two computer whizzes were able to do so. She also stated that bad actors likely manipulated the software and that there were many thousands of votes run through many times, and many thousands of votes that had the circles filled in exactly the same.

There was so much evidence of fraud that she ruled the case will be going to trial in January.
