I’m not sure of the specifics of his proposal, but in general, a witness can receive “use immunity” for testimony in front of Congress. That means that the DoJ cannot use anything the witness says or any evidence they develop based on the witness testimony to prosecute the witness. The problem in this case is that by the time an indictment is handed down, the prosecutor has already got the evidence they need. A witness receiving use immunity does not make the evidence developed before the testimony or through sources other than the testimony invalid or inadmissible.
