For all practical purposes the 9th and 10th Amendments died at Appomattox on April 9, 1865. Ulysses Grant and Abraham Lincoln performed last rites.

Further dirt was thrown on the grave with Wickard v. Filburn in 1942 and the enactment of the civil rights laws in 1964 and 1965.
