The fact that I am having to defend an individual based on internet accusations, before an investigation has even taken place, shows how far this website has devolved.

One thing is certain: the leaker, whoever it may be, once disbarred - and possible even prosecuted - is a guaranteed shoo in for congress as a dem. Assuming the party can persuade a sitting dem to step down for the vacancy. (Good luck with that).

I do not believe the FBI prosecutes anything. They are the investigative agency. Also while I think this leak will backfire tremendously, the question I have is what law did she break?
The call for prosecution without there being a crime is a little scary. Remember, our system was set up on the theory that it was better for 100 guilty men to go free, than falsely convict one innocent man.

If they can’t quickly find the leaker then all the clerks and staff must be fired. The SC can’t do it’s work under the threat of leaking.

With the exception of the soon-to-be-retired Breyer, I would not expect that any of the Justices would get close enough to leaking an internal Court document to leave even a hint of a fingerprint. Actively participating in such would arguably be an impeachable offense.
As for the clerks, I have heard lawyers argue from both the right and the left that this would be grounds for permanent disbarment. That’s pretty harsh, even if you are young enough to find something else to do with your life, such as legal analyst on MSNBC. But its not like giving up a lifetime appointment to the bench.

I don’t like this ‘doxing’ of someone on the basis of circumstances. The Chamberlain person should have waited to amass proof.
This kind of thing happens to innocent people all the time, now. It could happen to any of us, if we happened to be adjacent to something wrong that happened.

Why would Breyer do this? From all accounts, he’s a stickler for following procedural rules, and that’s one of the reasons he was pissed when his retirement plans were leaked.
