Agree. He’s weak, has no principles, and will go with whatever will get him praise from the left.

I’m always amused by people saying he’s “being blackmailed.” For what? If he were gay, it would be a resume enhancers.

And why would they need to bother, when they can get him for free just by stroking his ego?

This sounds like what is known as judicial erosion. Roe’s right to abortion stands but just gets shrunk down to 15 weeks, and not the second trimester. That would allow for medical advances for when a fetus becomes viable perhaps. Roberts is trying to but a facade on it, and the other true conservatives on the court apparently won’t have. He may also be delaying things, perhaps until after the election.

Isn’t this decision just basically turning the power over to the states. If the states want it to stay the same then just keep it the same. If they want to change it then they can. Were they kind of doing that already.. The people in the states can vote for it.

One of the big issues in 2012 was the constitutionality of the individual mandate — which even the drafters of the bill said was not a tax and was never intended to be a tax, and their attorneys argued before the Court that it was not a tax — and severability: Could the ACA be constitutional if the individual mandate was removed. So, if the individual mandate wasn’t a tax, the individual mandate was unconstitutional; if it was a tax, it was. If the individual mandate was unconstitutional, could the ACA still remain without it?

Roberts avoided the issue of severability by joining the libs in saying the individual mandate was a tax, and therefore constitutional. Thus, the issue of severability never really came into play, and ACA was upheld .

Bottom line: Neither Roberts nor the libs wanted to make a decision on severability.

Robert’s “let’s make a deal” is exactly what should not be happening on the SC.

Umpires do not make deals.

Oddly enough, his “tax” ruling on ObamaCare was quite sound.

Only one of nine justices thought that it was justified as a tax. Every other justice involved thought that argument as BS. Furthermore, there is the small issue of that "tax" not originating in the House, as constitutionally required.

The sane way to have done this was legislatively. The Left overreached, and we went from first trimester under Roe to third trimester, which hardly anyone but the hard Left supports.

I really don’t know how Roberts can do the sane thing while overruling the other decision, but it sounds like he’s outvoted if this stands anyway.

Any gain from this will end up giving the Democrats a victory, and you can bet they will do legislation at the Federal level.

Congratulations on insisting on a single-issue vetted list, barring any other potential candidates for high court justice, you have just screwed us all far worse than you can imagine, unborn included.
