I think there is more to the story then is being told. First was he out shooting as part of a scene, or was he acting up. And as this going to head live ammunition in it, how could it even be considered a prop? He should be charged with manslaughter until proven otherwise.

If he was “joking around” and pointed the gun at them and fired, manslaughter is an appropriate charge. If the gun was loaded with an actual bullet, everyone responsible for checking the gun should be also be charged.
How does a dummy round go through a person and then seriously wound another?

Charging somebody "until proven otherwise" seems completely opposite of "innocent until proven guilty". Even for folks we don't like.
