The Democratic Legislature passed the bill allowing Murphy to send mail in ballots to all registered voters.

Since when did PA have a Democratic legislature?

Sorry but you've made a total hash of the legal issue.

The suit says Act 77, which expanded absentee voting, likely violates the PA constitution.

Act 77 was passed by a Republican majority of the PA House and Senate in October of 2019.

This suit and ruling has nothing at all to do with the SOS or Governor. It's saying the Republican PA legislature screwed up in passing unconstitutional legislation.

By the way, the judge is also clearly saying that in her opinion the state legislature's power to decide how electors isn't plenary - it's subject to the state constitution.

The suit alleges that Act 77 constitutes an amendment to the Pennsylvania Constitution by creating yet another exception to the in-person requirement. But Amendments to the Pennsylvania Constitution — pursuant to the terms of the Constitution — require that the proposed Amendment be passed in two consecutive sessions of the General Assembly, published for six months in two newspapers of general circulation in each Pennsylvania County, and then approved by a majority vote of electors in the next general election. Act 77 was passed in only one session of the General Assembly, and the Democrats in control of the State Executive Branch put it into effect without completing the remainder of the steps needed to amend the Constitution.

Right, like I said. The allegation is the laws passed by the Republican legislature were unconstitutional. Nothing about the SOS or governor.

There were no newspaper announcements or second approval from the next legislature which means the soonest it can happen is 2022. We will see if you are right or I am soon.

Murphy is gov of NJ. He pulled the same stunt but had a all dem legislature that voted to okay all mail in after Trump legal team sued Murphy
