Attny General Barr is setting this up nicely.
The longer the court keeps the Flynn case alive, the longer the DOJ is obligated to produce documents damaging to the case.
He has put it on record that there is evidence that he has as of yet not been able to make public for reasons not specified.
Expect it to become public in the near future.
This will not end well for the court. They are obviously trying to move heaven and earth to keep the Flynn case from being dismissed before the general election.
This is going to backfire on them

Trump can put an end to this at any point, beyond the reach of any prosecution, by pardoning Flynn.
Rendering all the deep state games to keep the charges hanging over Michael Flynn, moot.

If it is done right, the storm would follow within milliseconds; in such a way the Dem party would be destroyed forever.
Depends on whether the Appeals Court is following a script written for them by the Good Guys, or if they are this desperate to prevent what's coming.

There is no controversy to be settled by a judge - the judge made stuff up and moved from being an umpire to a self-appointed prosecutor.
