Owning the land has to do with state “stand your ground” law: if it’s not your ground then it’s not yours to stand. Point is it IS theirs, so under state law their act is explicitly protected.

Other cases could be made, but owning that land makes the easiest case.

In Florida, you don’t even have to be ON your own land.................
