The Founders vision began to die early with Marbury v. Madison. It began a slow death with the Civil War, accelerated during the first progressive movement around the turn of the 20th Century, accelerated further under FDR, and finally died when communists took over the Dem Party and many of our nation’s institutions. We are in a post-Constitutional phase.
Brutus was right all along.
I would make the case that the events surrounding the Whiskey Rebellion in the early 1790s were completely at odds with the Founders’ vision for America.
