The Donald is not a Catholic and in the eyes of the law, he is married. Of course, I have no idea what the Presbyterian Church has to say on the matter.

In the eyes of Melania, because she is a Catholic, Donald has never been married to anyone.

In the eyes of the Catholic Church—i.e., in reality—he has never been married, because he has had a pre-nup before each wedding. A pre-nup invalidates a marriage.

Therefore, in reality, he is free to marry Melania as soon as he tears up the pre-nup.

At that point, Melania, who is a Catholic, will be validly married in the the Catholic Church.
