Since Hillary will not have been tried there would be no double jeopardy risk if she were to be prosecuted by the trump admin. Assuming there is some mechanism whereby a pardon can be revoked.

If hitlery wins, they will figure she’s safe enough without any pardon, because a pardon would look bad and unnecessary at that point.
