They were very careful to write in terms of reporting rumors and allegations, which is in fact true, there have been rumors and allegations. If they’d have crossed the line and written that Cruz actually had affairs with these women, then it would be actionable if untrue. They didn’t do that. They’ve been sued before, and have gotten a lot more cagey.
