Mark Levin has spent years defending the Constitution, his radio show bumpers refer to him as "Mr. Constitution". In his view, the constitutional debates and the views of the founding fathers should determine its meaning.
Levin has abandoned this standard in his defense of Ted Cruz's eligibility to run for President. This is evident in at least two ways - ignoring the founders' intentions and arguments, and suggesting that there are only two types of citizenship: naturalized and natural born. Levin revisits this issue with exasperation every day, knocking Mr. Trump and others for discussing it. Last week he referred to the issue as a 'turd in the swimming pool'. Let's examine it.
Canada is a possession of the English Crown. The analog in the founders time was England itself. Levin is suggesting that a person born after the founding, in England, with English citizenship, to parents of mixed allegiance, would have passed the founders' scrutiny. That idea should seem absurd on its face.

Can you name one serious constitutional argument, with attendant authority, that Levin has mentioned to attempt to establish Cruz’ constitutional eligibility to be President under the requirement of being a “natural born citizen” as set out in Article II?
I’m a Cruz guy myself but either of them would be preferable to Sanders and that other lady who is running.
Natural Born Citizen = born on the soil to two citizen parents.
That is the purest grade of citizenship there is, and it’s what the Framers had in mind when they put that requirement for office of president into our Constitution.
Why am I unhinged for being concerned that I might waste my vote voting for someone who could be disqualified by any judge who decides to do it?
Why should I risk my vote, and why does my worrying that my vote is at risk make me unhinged?

The blogger’s explanation of the three levels of citizenship is what I was taught in school as a child. When I had my first child outside the USA, I still believed that he was ineligible to become President. Since doing my research on Obama, and since knowing that anchor babies will be considered NBCs by this standard, I’ve come to think that maybe Levin’s response is correct. That someone like Ted Cruz, and my son, are NBC because they were born to American women outside the country and did not need to naturalize.
The truth is that we do not know precisely if ther are three stages of citizenship or two.
The truth is that we need a final, precise definition and it probably needs to be an amendment. I don’t care personally which way, at this point, we just need a precise definition. Don’t know what will become of Ted Cruz and his eligibility. He might not win the nom so it might not matter this time, but he could have been a greet veep candidate if this were decided already.
He did push Jeb off of the radar...for the moment.
I am cautious about declaring him dead just yet.
Born a citizen is not synonymous with natural born citizen.
This is a difficult case to read and understand. But it is an important case for the anchor baby argument. This case, and Plyler v. Doe, enable invasion of this country over a period of time, by birthing to the invaders.
For me personally, the fact that he was born to an American mother is enough to establish NBC for me.
My problem is that I don’t have anyway of knowing if I am right or if a judge will agree with my assessment.
I could be totally wrong.
Frankly, I don’t see anything wrong with those requesting the matter be settled. I’d like the matter to be settled.
I see something wrong with those saying there is no matter to be settled, and you’re crazy for thinking that there is.
