CHICAGO Employers in Illinois can no longer access criminal background checks on potential hires until after an interview is conducted.
Gov. Quinn signed into law this week a bill that prohibits private employers from asking applicants about their criminal history prior to determining if they are qualified for the job.
Everyone deserves a second chance when it comes to getting a job, Governor Quinn said in a press release. This law will help ensure that people across Illinois get a fair shot to reach their full potential through their skills and qualifications, rather than past history. It will also help reduce recidivism, fight poverty and prevent violence in our communities by putting more people back to work.

Exactly. This is an Illinois Governors’ and Elected Officials Protection Act. And I’m sure it has bipartisan support.

These are two completely different things. In my experience, background checks are very rarely done on people until we've decided to hire them. Why? Because they cost money. So if that's what the law prohibits, it's completely useless.
Asking, "Have you ever been convicted of a felony? If yes, explain." on a job application is completely different. If that's what the law prohibits, it's completely asinine. For instance, (at an extreme example) I'd never hire a convicted child molester to work in a day care. Doesn't matter how "Well-qualified" and "Rehabilitated" the person is.
Another reason to move your company out of IL. What in the world are they thinking???

The trouble is it may not be a 'second' chance. We have career criminals that shouldn't even be on the streets.
Illinois is bordered by Wisconsin, Iowa, Missouri, Kentucky, and Indiana. So why not “outsource” your employment screening just over state lines?
Not the whole business, just the office that handles new hires. And if it ends up hiring people in those other states willing to relocate to Illinois, no problem.
