FReeper Betty Jane Needs Gun Rights Advice
March 20, 2014 | FR's Betty Jane

FReeper Betty Jane (FR class of '98) writes:

A young man has been summoned to meet with the President of his college, Chattanooga State community for wearing an empty holster. A teacher complained. He has to meet at 2:00 pm. eastern today.

He plans on recording the conversation. He can’t afford a lawyer, and neither can I. He is 22 or 23. He doesn’t belong to any gun rights groups.

My #1 Son and I have an ongoing Go match. It’s the kind of game that will never end.

But my reason for choosing the screen name goes far beyond the vacuous pop culture reference of the novel.

Yeah, but it was still an entertaining read, and I learned something that I didn't know before.

:-)

I'll put this here for the others:

The Meaning of Shibumi

Shibumi is a Japanese word meaning refined simplicity, simple elegance and quiet perfection. It is a highly prized quality that few Americans and Europeans understand or appreciate. Shibumi has nothing to do with the flashy, decorative beauty admired in the west but refers to a clean, simple, restrained sense of distinction, refinement and taste. Shimbumi is strict, thrifty and without tournament. You can see shibumi in every facet of Japanese culture. It is reflected in the simplicity of Japanese art, calligraphy, rock gardens and modest décor of their homes.

One most important point: DO NOT SIGN ANYTHING IN THAT MEETING!

If they give you any document, for example stating that you acknowledge that the carrying of an empty holster caused distress, take the document and say "I'm going to have my attorney look this over first", and put it in your pocket..

Second important point: starting now and for the next several weeks, do not have anything in your car, person, or backpack which could conceivably be called a weapon. No pocket knife, no pepper spray, no nothing. I would even park off campus and walk to campus, or have a friend drive me. Give no access to your vehicle which they could use to plant anything.

Third: if the school demands permission to search anything of yours (car, backpack, locker, whatever), say "I do not give consent to any search for any reason".

Fourth: Have a buddy outside the meeting place watching to see that you come out OK, and are not arrested at the meeting, and give instructions on what to do in that case.

Tell him to wear the holster to the meeting, loaded with copies of the Constitution, Second Amendment highlighted.

Tell them wusses to talk to a Lawyer not the Student.

Pure INTIMIDATION BS!

Was the request verbal or in writing?

If writing was it deliver by a Process Server, a “Real LEO”, a fake one, certified/registered mail or what/who.

The dipsticks wanting the meeting are gonna lose.

We also need:

Name
Email
Phone #’s
Postal Address

For these wusses so that they can “become Educated”

Thank us all later.

Right now, get your young man squared away before his meeting.

Maybe you should have asked more than an hour before the hearing, and then perhaps some freeper lawyer (like me) who lives an hour and half away might have volunteered to help for lunch and gas money. Then again, maybe not as wearing an empty holster is a pointless gesture intended to provoke rather than as a legitimate exercise of rights.

To: kiryandil; All

Take control of the dialog.

The first statement should be;

“This is a demonstration of my FIRST amendment right.”

“Surely your not against my right to freely express myself”

I wish I had more time before seeing this. I am not licensed in Tennesse. That said I recommend

1. Reread any codes of conduct. Don't violate it.
2. Don't sign anything before running it by an attorney.
3. Be respectful. Running the mouth causes bad consequences.
4. Do not consent to any search.

The thing to remember is that the college admins are not necessarily going to be interested in reasonableness or justice (perhaps they are, but assume nothing). Operate on the assumption that they want to get you, and keep in mind what happened with the EMT student in Ohio, who got railroaded over being a self-defense advocate.

The "empty holster" thing was a First Amendment statement, but could be taken as an attempt to intimidate ("I own a gun. I didn't bring it TODAY.").

Explain the symbolism as part of an advocacy for concealed carry rights, so they understand what he was trying to communicate.
