A current active duty soldier and Iraq War veteran’s target practice with an air rifle landed him in hot water this week.

The soldier was shooting at a target he setup on the side of his home with an air rifle. One of the projectiles (likely a BB or pellet) struck the glass at an under construction home nearby. It’s unclear if a ricochet was to blame or if it was a bad miss.

Unfortunately for the soldier, a Homeland Security agent who was a potential buyer of the home was inside it at the time. He called in an active shooter situation to local authorities. This resulted in two nearby schools being shutdown, a massive police response, including SWAT teams as well as an armored vehicle, and the soldier, 25-year-old Ramon Hooks, was taken into custody at gun point. He now faces charges of criminal mischief.

Shortly afterward, the federal agent called for help, saying shots had just been fired into a house he was walking through.

So who is right? The police said there was no evidence that they spoke to each other. Better air rifles do look like real rifles. They can use the same scopes and they are just as heavy.

My son gave me a birthday present of a really nice .22 pellet rifle. I set up a very protected shooting range which included a multilayer carpet backup cooler box in my large backyard. I intentionally set the target trap close to ground level at my 25 yd sighting distance and in front of a 6ft fence. I made sure by sighting that the trap was not in line with any houses. I was zeroing pellets that were chronographed at 850 to 1200 ft/sec. I checked the laws and even called the police dept. to tell them what I was planning. No problem as long as pellets stayed on my property. I was enjoying shooting my new rifle when the police came to the door. A neighbor had reported I was shooting at and killing birds. An absolute false claim. I had a good chat with the officers, a seasoned lady cop and a punk cadet cop, and told them my next shooting would be on some mountain property. It is the neighbor who pounds on his house at any time of the day and the young have-a- badge cop who need some learning.

The guy for Homeland is beyond stupid.

As are some of the comments I've seen from some idiot posters here. Their ready and wiling to bend over and take it, just call the police and make it worst that it is.

“bfl” Agree that the HS person was most likely experiencing a wet dream about being a hero. Also, if you watch the news video there is a rather large women claiming the “weapon” was an “AK-47”. Sheeeeeesh.

Anyway I Google Earthed the location and see that the area has a lot of open fields and places he could have shot his air rifle. Also you can see that the location has only a few houses in a subdivision that appears to have been built before the real estate bust. Although I see where he probably assumed that there were few people around his mostly vacant subdivision and got away with his BB gun shooting activity until discovered by the HS super secret agent looking at one of the houses up for sale.

I think Mr. Hooks made a poor choice of location in shooting his BB gun but a swat response with armored vehicle was a a little over the top...

What scares me is the military like police and I fear that they have no intention of protect or service to citizens. This army is similar to Nazis beginning. We must start disbanding most police and rebuilding.

P.S. I do shoot grackles with my pellet guns.

Every year when the Grackles arrive I go out with my pellet gun. Don't really have to hit them (though it wouldn't bother me if I did) because they are skittish and all take off. After a few days of that the neighbors end up with the birds and the nests and the crap and the noise.

Why don't you continue to shoot in your backyard? If your neighbor keeps calling it in they'll be the ones in trouble.

Then the police are lying, because they have Mr. Hooks testimony that they spoke to each other. There may be other, contradictory testimony, but clearly there is some evidence.

Sounds to me like they are covering for the federal agent.

He wasn't charged with a 'firearms' violation as Texas Code doesn't classify an 'air rifle' as a 'firearm':

(3) "Firearm" means any device designed, made, or adapted to expel a projectile through a barrel by using the energy generated by an explosion or burning substance or any device readily convertible to that use. Firearm does not include a firearm that may have, as an integral part, a folding knife blade or other characteristics of weapons made illegal by this chapter and that is:

Unless someone corrects me, I neither find any definition at all for 'air rifle' under Texas Penal Code in regards to 'weapons' nor any other definition of any kind (it's a 'toy', insofar as TPC goes)...

As far as the charge of 'criminal mischief' goes:
Texas Penal Code - Section 28.03. Criminal Mischief"

If Texas Penal Code had it in there, he'd have been charged with 'being stupid'. As for SWAT's response goes, another FReeper pointed out 'it's their job'; I agree in this respect (ignoring the obvious 'police state' aspect), as they were reacting to the chicken-$hit alleged-DHS agent that called in the 'threat' in the first place (missing details, imho, on what exactly he reported...response says enough).

Maybe it's just me, but this idiot would have had the fear of God put into him long before SWAT got there, federal/LEO credentials or not.

Of the few sites carrying this story, this one has some very good commentary on the DHS idiot, but still ignores the troublesome little detail: this could have been bama's son, too. 'stupid is as stupid does'... I'm just noticing that NO 'MSM' sites have picked up this story, despite the 'gun angle' and even Yahoo's piece is 'softball. Ya know? I made a comment in another thread about the caliber of personnel coming into the services the past few years; my boy had quite a bit of negative experience with it while stationed in Germany in between tours (that thread was about photo of the moron airman/gal tonguing the POW/MIA logo); this really puts a spotlight on that 'caliber' (no pun intended)...but the 'race shadow' and the actions of the alleged-DHS agent seem destined to keep this story in the weeds... .02

That would depend on whether or not the shooter was within cite.

If no one could say for certain that they had sited the shooter doing the deed I would decline.

I figure THEY put my name on the list long ago. Already bee threagtened with six figure fines and federal prison for nonexistent EPA violations. Funny thing is it took three days for the EPA drone to find my place but the mail finds it six days out of seven. I think it IMPOSSIBLE foranyone to be in compliance with all laws .
