I don't understand why someone can't sue on fifth amendment rights ("...nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.") and/or eighth amendment rights ("Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.")

The 4th and 5th Amendments used to protect the people against unlawful seizures without recompense but they were written out of existence by RICO laws.
