Courts don't make law. Article One, Section 1 grants that power only to the Congress. All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.
The judiciary is constitutionally-empowered only to make constitutional, lawful decisions in particular cases that come before them.
The executive is vested with the duty to enforce the Constitution and all constitutionally-valid, duly-passed laws.
You, along with millions of your fellow Americans, sadly, have bought into a fundamental Big Lie, an anti-republican, anti-constitution, judicial supremacist Big Lie that is destroying this free republic more than just about anything else I can think of. One which has already destroyed more than fifty million innocent, helpless, defenseless little children.

Yes, it is, being part of the document and its statement of purpose and all.
