Exclusive: Court Subpoena for Obama’s Original Birth Certificate Served to Hawaii Health Department

(Jul. 5, 2011) — A process server has delivered a Hawaii court-issued subpoena to Loretta J. Fuddy, Director of the Hawaii Department of Health, commanding her “to produce at the time, date, and place set forth below the following documents, electronically stored information, or objects, and permit their inspection, copying testing, or sampling of the material:”

original 1961 typewritten birth certificate #10641 for Barack Obama, III [sic] issued 08.08.1961, signed by Dr. David Sinclair, Stanley Ann Dunham Obama and registrar Lee, stored in the Health Department of the State of HI from 08081961 until now.

The subpoena allows Fuddy until August 8, 2011 at 10:00 a.m. to produce the document.

The designated place of production is noted as:

Health Department State of HI 1250 Punchbowl str. room 325 Honolulu, HI 96813

“I just had this discussion recently (click). June and July would be considered “summer”.”

But it was promptly pointed out that none of the supposed examples actually involved someone saying that two citizen parents were always necessary.

Two of the three examples were posters saying that two citizen parents were necessary IF THE CHILD WAS BORN OVERSEAS. And the third (Dante3) wasn’t saying it was necessary to be born of two citizen parents on US soil, only that it was unequivocal that being born of two citizen parents on US soil was adequate.

If there really was an old requirement that all Presidents be born of two citizen parents, you’d think it would be easy to find plenty of people saying “All Presidents must be born of two citizen parents.” Or better yet, books that say that. You wouldnt have to pretend that the linked comments above say that.

These issues should be clarified. The original, unchanged birth certificate for any candidate for POTUS - Obama and McCain' should be public record. Also, both parents have to be American citizens and the candidate has to be born in this country.

Questions have been raised about the eligibility of both candidates, especially Obama, and there should be no problem in verifying the information. What if Obama's mother had renounced her citizenship? For McCain, being born on a US military base is not the same as being born in the USA. In view of the outlandish decisions by the Supreme Court, it would come as no surprise if it said McCain did not meet the criteria.

The date is 07/19/2008. The comment is "both parents have to be American citizens and the candidate has to be born in this country". The context clearly includes both Obama and McCain, and "any candidate for POTUS" for that matter. In post #50 you reference, Dante3 clarifies his opinion further by going on to say

"There is no question if both parents of a candidate are citizens AND he is born in the United States. If not, then it needs clarification. I would not want a POTUS who holds dual citizenship. "

If you truly believe I've misunderstood Dante3's opinion, or that he does not actually believe the POTUS must qualify with pure allegiance, by all means, ping him and ask him directly to educate you. Otherwise, wise up.

As for the rest of what "you'd think", Rep. John Bingham (the primary author of the 14th Amendment) described his understanding of natural born citizenship in 1866 :

"[I] find no fault with the introductory clause [S 61 Bill], which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen"

And prior to that in 1862, while discussing his understanding of citizenship, Bingham stated

"There is not a textbook referred to in any court which does not recognise the principle that I assert."

If you want to join the ranks of those with their eyes closed pretending history isn't what it is, feel free. As for me, I'll stick to learning history and the expressed original intent. I don't 'know it all' yet, but every day puts me a step further ahead of those who make no effort at all.
