don’t get that excited. “In conference” is code for slush pile. His case is highly controversial. To quote Justice Thomas on natural born citizenship, “We are evading that question.” So, don’t hold your breath.

Agreed. Two of the justices need to recuse themselves from making a determination on this. Therefore would only need 4 justices to affirm in order to move forward.
Apuzzo is a top rate attorney, especially on the constitution...but I will NOT get my hopes up...I will expect the worst...

The good news is that the case made it to the "slush pile." The bad news is that if it didn't come up from the Federal District Court in DC, there may be ample Constitutional grounds NOT to hear it and let lower court rulings stand.
