Neighboring edge-of-Appalachia dairy farmer wrecks car on way home from bar. Gets a ride home, answers door when cops knock. When cops ask, admits that wrecked car is his, and that he'd been drinking at a bar. Cops haul him to closest clinic emergency room (15 miles) for blood alcohol test, subsequently charge Driving Under the Influence of alcohol.
Have heard from Christian radio shows interviewing purported Christian lawyers (oxymoron?) that anyone who ever answers any cops' question about anything is probably taking an un-necessary risk.
You lose. They cooperated fully with all questions. It just didn't seem to matter much, until the very end.
>>>For some reason I am reminded of the Duke boys and now Sen Stevens.. ‘nough said.<<<
Miscarriages of justice do occur. However, I don’t believe either Stevens or the Duke boys were tricked into confessing to anything. These were cases of prosecutorial misconduct, not false confessions.
In the Duke case, I believe the innocent men cooperating with the police (giving DNA, alibies, etc.), actually helped clear them. If Nifong had acted like a normal, ethical DA, the charges would have been quickly dropped, as a result of that cooperation.
I think every situation is different. If you know you are innocent and know you can prove it, talking to the police probably makes sense, though you still might want to have a lawyer present.
If you are guilty, or are inncoent, but know there is some evidence that makes you look like a suspect, or you feel like you are getting railroaded, you should probably keep your mouth shut.
I agree he didn’t exactly tactfully handle the situation but there was no probable cause for them the harass him in the first place, unless sitting quitely on a bench at 2am in a tux is suspecious. It reminds me of the first Rambo movie.
Well..., yeah, but I also know that *anything* going on after midnight — and you can expect cops to be asking questions, no matter what...
“Midnight” is the “bewitching hour” — as far as getting cops interested in what is going on... LOL...
I agree with your post. But make no mistake, there are those who enjoy lording over the people.
I do NOT subscribe to the “lower your eyes and your voice, speak as if your inferior and seek to please” method of “dealing with a police officer.” They work for ME. Of course only an idiot would say THAT to a cop!
Excellent... thank you for posting.
Better yet is to have a law firm that will personally answer the phone 24/7/365 days a year.

While it may be a funny quip, “in real life” it’s a quip that no meaning in reality... LOL...
In actual fact, all it takes is being prepared, knowing who you would call if necessary (but you don’t have to have them on a retainer) and having their business card ready and available (something that costs nothing). If you do it right (and there are forms in which you can “prepare” for any such encounter with police) — it will cost nothing and you will not even have to call the lawyer’s office.
If you do have to call the office — then you *really do need him*... LOL...
