PLAINTIFF’S RESPONSE TO ORDER TO SHOW CAUSE Plaintiff, Gregory S. Hollister, through his counsel, John D. Hemenway, Esquire and Philip J. Berg, Esquire, hereby Respond to Honorable James Robertson’s Order to Show Cause issued February 25, 2009 as follows

1. Pursuant to this Honorable Court’s Order of February 11, 2009, Plaintiff through his undersigned counsel complied with this Honorable Court’s Order and timely filed a Response in Opposition to the Defendants Motion to dismiss on February 13, 2009 which appears on the Pacer Court Docket as item number thirteen (13). A true and correct copy is attached hereto as EXHIBIT “A”.

2. Plaintiff’s Response in Opposition to the Defendants Motion to Dismiss consisted of thirty eight (38) pages in total, which included a proposed Order, one (1) page; Plaintiff’s Brief in Opposition to Defendants Motion to Dismiss, two (2) pages; fifteen (15) pages; Exhibits, fifteen (15) pages; Affidavit of Service, one (1) page; and Declaration of Lisa Liberi, five (5) pages.

3. In this Honorable Court’s Order to Show Cause his Honor states he received “many blank pages, decorated only by what appear to be botanical drawings and the illegible photocopy of an Hawaiian certificate of live birth.…The blank pages were either somebody's idea of a joke (in which case I don't get it) or a mistake.” Counsel for Plaintiff would never file blank pages or attempt to play any type of a joke on this Honorable Court as Counsel for Plaintiff have too much respect for the Judicial system.

I agree with you that BO should release the information. I don’t know that I would accept an allegation in a lawsuit as proof of anything. I have heard the claim that Maya has a Hawaiian birth certificate a number of times, but have never seen anything to prove that is true. How would anyone know what birth certificate she has? If Hawaii won’t release BOs why would they release hers?

If the actual document(s) on file in the Hawaiian vault do not match the thing offered publicly as his ‘proof of natural born status’ then he is open to criminal charges. We are witnessing the utilization of the fifth amendment not to incriminate ones self as played by an affirmative action, arrogant, condescending socialist.

How would anyone know what birth certificate she has? If Hawaii won’t release BOs why would they release hers?

Remember, Hawaii, Occidental College and other sources would release this documentation in a heartbeat, if Obama gave the word. The record-keepers are sitting on this stuff because they haven't been given a release by Obama.

I am hammered all the time about this stuff. I am constantly being asked to prove this allegation or that allegation.

The fact is, no one can prove anything without the documentation, and Obama is fighting tooth and nail to keep it buried. The question is why?

And this conversation doesn't even take into account all the stuff that has disappeared from the World-Wide Web.

I contend that it is Obama's responsibility to prove that he's eligible. He can do so with a phone call. Instead he has teams of lawyers fighting 48 lawsuits and he's spending a fortune to do so. Why?

It is not my responsibility to prove he's not eligible. But I am damned well entitled to question his eligibility. There is sufficient good information to do so.

Y'all know I am a skeptic on a lot of this but jeeze, Bambi's lawyers are playing games.. from filing motions referring judges to a website to see a document to this, they are either stupid, cocky, or trying to get cases thrown out..

It was the Judge who said the plaintiff's motion papers were blank, not Obama's lawyers. It later turned out there was a technical glitch that kept the judge from seeing them (the brief was filed electronically).

By the way, here's what the judge wrote in his order to discharge:

Plaintiff's opposition to defendant's motion to dismiss [#13] was illegible on most of the Court's computers, as was plaintiff's response to the Court's order to show cause [#15], because plaintiff filed documents scanned with resolutions so fine that they overwhelmed the Court's CM/ECF system. On the Court's website, go to ECF Filing Pointers and then to Attorney's Checklist, for instructions. The Court's order to show cause [#14] is discharged.

Read the Soetoro divorce papers. On the documents, entitled, “Information Concerning Child Care,” signed on June 15, 1980, Anna states “both mother and child are U. S. citizens, while father is an Indonesian citizen.”

The papers were filed in Hawaii, but Anna was living in Indonesia — Under living arrangements, the documents states, “oldest child in university and mother resides with youngest child in 4 bedroom home provided by mother's employer (USAID); household includes 2 full-time live-in domestics.”

Now, how do you suppose Maya, born in Jakarta and living in Jakarta, and the daughter of a Muslim Indonesian became a U. S. citizen?

The answer is, Anna filed for an amended Certification of Live Birth for her daughter, who was unquestionably an Indonesian citizen.

Anna hated the U. S., but she kept one foot in it her entire life while chosing to live and work abroad.

If you want a copy of Maya's COLB, why don't you petition the State of Hawaii, Department of Health for it, and while you're at it, get Obama’s too.

She is a former federal examiner and law enforcement officer. She began training as a forensic document examiner in 1991. She is a Certified Diplomat of Forensic Sciences, a member of the American Society of Questioned Document Examiners, a member of the Southwestern Association of Forensic Document Examiners, and a member of the Questioned Document Subcommittee of the American Society of Testing and Materials.

She stated, in a sworn affidavit, dated 12/4/2008: “After my review and based on my years of experience, I can state with certainty that the COLB presented on the internet by the various groups, which include the ‘Daily Kos,’ the Obama Campaign, ‘Factcheck.org’ and others cannot be relied upon as genuine.”

Does that count?

No, the answer is the US Immigration and Nationality Act of 1952, Section 301(a)(7):

Nationals and Citizens of the United States at Birth

(7) A person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than ten years, at least five of which were after attaining the age of fourteen years

Maya was a US citizen at birth, even though she was born in Jakarta, Indonesia.

Ironically, you Birthers should know this already as that's the very same statute that's cited by those who claim Obama was born in Kenya and that his mother wasn't old enough in 1961 to confer US citizenship on him. However she was more than old enough in 1970 to confer US citizenship on Maya.
