The way I interpret this is IF Electors change their vote, and can legally and Constitutionally justify their actions, the Supreme Court could rule their actions were justified and not permit those Electors to be punished for acting as they felt compelled.

Although the Supreme Court ruled in ‘52 that electors are acting as a function of the state, not the federal government, the Electoral process IS a Constitutional function. That certainly falls within the purview of the US Supreme Court.

For example, let's say the SCOTUS refuses to take ANY action on Dec. 5 — they decide just not to get into the fray. Electors from different states start calling one another on the phone, especially those from barely-blue states, and decide they cannot vote for Obama. They change their vote for McCain and somehow McCain gets 270-plus votes.

Later, those states then try to sue those electors, probably spurned on by the DNC. It works through the court system and then is appealed to the SCOTUS next summer. The electors’ attorneys are able to argue the case, and the SCOTUS rules they are not to be fined because the Electors did not feel Obama was Constitutionally-qualified. As a result, the SCOTUS could decide those Electors are not to be fined. I mean, after all, the Electors have the ability to change their vote in this stage of the process. Congress simply accepts those votes — Congress cannot change the Electors’ votes.

All this regarding Elector punishment is conjecture, of course. It's not be tested yet. We are truly in unchartered territory. I hope the SCOTUS will reaffirm what most of us here on FR believe — only a Natural Born Citizen (who doesn't have DIVIDED-INTERESTS due to Dual Citizenship) can hold the office of President.

Don’t bet the ranch on Biden becoming anything. First of all, he was appointed, not elected. Secondly, the collusion of the DNC in the coverup and the failure to vet their candidate will be the end of that jackass party.

Way back when, Americans used to vote for the Pres. and Vice-Pres. separately, until they elected two bitter adversaries to both posts who nearly killed each other. So, the law was changed,

Secondly, this election WILL be decided by the Congress, IMHO. However, and here’s the real a**kicker if you’re a Dem: it will be one vote per state in both the House and the Senate. With more RED states than BLUE states, the pendulum will swing the other way.

My wife is in the Czech Republic right now. She has had TWO people ask her how Obama can be president since he wasn’t born in the US!!!

Of course the Kenyan Ambassador is lying.

How can it be otherwise.

What if they choose to not take up the case? Isn’t this always going to be a constitutional issue? What can the American people ever do to know if their President even meets the two little qualifications needed?

From my memory of a political science text written recently (last year), you are 100% correct.

One vote per state from each House of Congress will decide.

We need to have some basic facts translated into multiple language and sent to foreign media outlets and blogs.

I encourage you to go and read it directly. You deserve the privilege to begin to discover whether the presumptive president-elect is headed to the White House and whether, to a much less auspicious federal house.
