This is interesting. Souter tells Obama to produce the vault copy by December 1, 2008. I believe the messiah will defy the Justices.
Who will force the issue? Who wants to open up that pandora's box? Imagine if there is something on that birth certificate that disqualifies Obama from the office of the President. What are you going to do? Start a civil war? There will be blood in the streets you try to enforce the rule of law. This should have happened before the election. Obambi knows it too.

At this point, Supreme Court Justice David Souter's Clerk informed Philip J. Berg, the lawyer who brought the case against Obama, that his petition for an injunction to stay the November 4th election was denied, but the Clerk also required the defendants to respond to the Writ of Certiorari (which requires the concurrence of four Justices) by December 1. At that time, Mr. Obama must present to the Court an authentic birth certificate, after which Mr. Berg will respond.
If Obama fails to do that, it is sure to inspire the skepticism of the Justices, who are unaccustomed to being defied. They will have to decide what to do about a president-elect who refuses to prove his natural-born citizenship.
"I can see a unanimous Court (en banc) decertifying the election if Obama refuses to produce his birth certificate," says Raymond S. Kraft, an attorney and writer. "They cannot do otherwise without abandoning all credibility as guardians of the Constitution. Even the most liberal justices, however loathe they may to do this, still consider themselves guardians of the Constitution. The Court is very jealous of its power - even over presidents, even over presidents-elect."
Also remember that on December 13, the Electoral College meets to casts its votes. If it has been determined that Mr. Obama is an illegal alien and therefore ineligible to become President of the United States, the Electors will be duty-bound to honor the Constitution.

At some point he does have to produce a BC, and that BC will prove him inelligible to take office; what then?
There is indirect reason to believe that this may be true. “2d Session S. RES. 511: Recognizing that John Sidney McCain, III, is a natural born citizen.: In the Senate of the United States.” was Sponsored by Senator McCaskill and co-sponsored by Senators Leahy, Obama, Coburn, Clinton and Webb. Why? Why were Democratic Senators trying to pass a Resolution making Senator McCain undoubtedly Legally Eligible when this issue had already been cleared up in 2000 and again in 2004? And why did Senators McCaskill and Obama reportedly insert the following Clause?
“Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President;”
This Clause has no particular relevance to McCain and the following Clause, which it is reported McCaskill and Obama attempted to REMOVE shows that:
“; and Whereas John Sidney McCain, III, was born to American citizens on an American military base in the Panama Canal Zone in 1936:”
It seems clear that McCaskill and Obama were attempting to create a blanket Resolution covering ALL Foreign Born candidates. Why do that if not to benefit a Foreign Born Democratic Candidate, who did not have a US Military background?
No, I think Souter is incapable of discerning it to be a forgery. Can you follow all the technical nitpicking that Polarik and others have been going on about? Only experts can. And Obama will have fantastic experts bought & paid for.

He is just the supervising SCOTUS justice for the district in which Berg filed.
He only denied the application to stay the election.
Obama has to respond as to why Berg’s petition should be denied, Berg has an opportunity to respond.
Then, all SCOTUS justices will review the petition and the responses. If 4 agree with Berg, Cert will be granted.
They NORMALLY would send the case back to the lower federal court, but due to the immense Constitutional questions and the time constraint, I think they will assert original jurisdiction (Supreme Court Review) under Supreme Court Rule 11.
They would then, presumably, ask for the birth certificate and forensic analysis.
Based upon those findings, they would render a decision.

When I was researching, I came across a law from like 1905 that stated anyone born to two U.S. citizens overseas in any U.S. territory, protectorate, or military installation was indeed a U.S. citizen at birth (natural born).
There was NEVER any need for Res. 511 ...

FYI: My cousin was born at Kadena AFB (Okinawa) in 1976. He is a natural born U.S. citizen.

I think that you’ve misjudged the penetration, and the extent to which Souter must have consulted his peers.
This is no ordinary case. That Obama cannot produce the necessary documents is about 99% certain. Legal scolars have been kicking this around since March, and most are at the same conclusion, regardless of which side they are on.
The only real question seems to be who will come out on top after the writ is handed down; it won’t likely be Biden.
