Couldn't an argument be made that this is a contractual agreement between private parties, and a certain level of security can be implied? The Fourth Amendment covers that, doesn't it?

On the other hand. If I were given the option for consent to this (the NSA studying call patterns) I wouldn't have a problem with it. Given the "asymmetrical war" we find ourselves in.
