On Friday, Nebraska's highest court ruled that a man whose ex-wife may have lied to him about being the father of their child cannot sue the woman for fraud and emotional distress. Why not?
IN ANY other realm of the law this would be a classic case of fraud. Robert Day had already been divorced from his wife for six years when he realized he was out of town when she conceived. A DNA test proved with 100 percent certainty that Adam wasn't his. Well Robert Day alleged that mom lied about her due date to fool him.
He had paid child support, medical expenses and even half of his wife's employment-related daycare costs after their divorce. She's since remarried. The court cited a number of psychological studies about the importance of parents bonding with children and held "In effect Robert is saying he's not my son. I want my money back" and that the lawsuit "Has the effect of saying I wish you'd never been born to a child."
No, it says "You lied to me, I want my money back," and the lawsuit has the effect of saying "I wish you hadn't lied and now hope you'll go after the real father for the money you snookered me from me." Look, these cases are difficult and different. If the result would be that the child would suddenly go hungry or lose his home, those special circumstances should matter, but that should be the exception.
The court's opinion focuses solely on public policy. How is it good public policy to encourage a philandering woman to lie? Why shouldn't she at least have to seek out the real father to make him pay?
Well said. And don't let your teeth get too close to your jerky knees.
You also are one sad puppy with a serious lack of any intelligence and insight.
Obviously you are delusional as well.
Perhaps in time you'll grow up. Right now you are a mess of insecurities, conflicting emotions, anger and helplessness.
These threads on subjects like this defintitely show we have much too many broken men in our society now.
If you guys could only see yourselves for your pathetic brokenness, you'd give up your irrational pride and stop feeling sorry for yourselves.
Do you feel broken? Beat down? Oppressed? A victim of society and the state?Well, welcome to the club. The liberal victocrat club.
It'll explain away all your troubles and problems, let you lay blame on others for your mistakes, and shirk your responsibilities, all the while giving you a contrived but seemingly well rounded view of the world to validate all your irresponsible actions and selfish deeds.
Victims, it's not your fault. It never is. Take heart, we are there for you.
From, your supporters, the Democratic Party.
We thank you for your support.
Here? Interesting choice of words, boy.
Something is either discredited or not. There's no "here" about it.
Except of course in the liberal whiner world view you wallow in where what's true for you might not be true for me etc...
You really have no idea what a pathetic broken down liberal victocrat you are.
Take care, you've given me a nice smile.
I always have to laugh at comments like this. The lack of self-awareness on your part (and your fellow boys) is literally laughable.
You and the other baby boys come in and heap abuse all over people, especially those you think of as weaker.
Then cry like babies about abuse.
It is a howler.
Like all bullys, you cry and whine when someone stands up to you and meets you at your level.
You understand me?
But you're an idiot, and nothing can change that.
I was single from age 42-46. I am a more or less successful man.
Before I married a 26 year old, I dated many, many women in the above-referenced situation.
I actually had women come up to me and ask me if I liked them, and if I wanted children-yes, in one breath.
What I don't understand is how it is possible to "come to the realization" that the mid-30s are too late after graduating from high school. This sounds to me like complaining that you didn't ever hear that smoking was bad for you, or that you didn't know that a diet of big Macs and fries could lead to obesity.
Most women in their 20s are more fertile, more attractive, and almost all of them are way, way, way less bitter than women in their mid to late 30s.
Athough there are conspicuous exceptions, any women who is planning to marry and have more than one child should have a few prospects by age 22 and should be married and pregnant by age 27 at the latest.
It's hard to understand why so many women today don't get it.
They dont get it, because they bought the Feminist's bill of goods about "having it all". They think that by the time they have gotten their Master's and SUV, that we are still going to be waiting around for them. The fact that they had the time to finish school is usually a testement to their relative attractiveness anyway.
So, here they come, briefcases in hand, ready to spawn, and not taking no for an answer, and they are like Salmon swimming upstream. Desparate, and in a hurry to procreate, so as to fill up that basket of fulfillment that Oprah promised them.
A man need do nothing but wait for them to show up, loaded for bear, at any venue, with their radar on maximum, searching for "Mr Goodjob".
Easy pickings for any man with stability and a nice car; you only have to be careful about giving them your address, because once they see your house, they are headed for Home Depot for nesting materials.
She on the other hand, will be wanting that first face lift right around then, on his Visa, so she's behave.
Aw, c'mon dude-at least you could wish me luck...
LOL - I seems to almost exclusively date women in the 19-21 year range. I'm 24 and in professional school and my friends and classmates always wonder why. My question to them is "why not"? The older a woman gets the crazier she gets. Some of the girls in my class are damn near certifiable, and they wonder why I won't date anyone from school. Forget that. I'll get serious after I finish my training when I'll be in a position to pick and choose.
I insist on well regulated estrogen. Once that hormone starts fluctuating in women (26-27) their behavior becomes too flaky to manage.
At 30, you might as well lock them up.
Now, watch as the harpi's desend on me to deny it.
