Bullet used to kill Charlie Kirk did NOT match rifle allegedly used by suspect Tyler Robinson, new court filing claims

The bullet that killed conservative commentator Charlie Kirk did not match the rifle used by suspected killer Tyler Robinson, a bombshell new court filing states.

Robinson, 22, is facing capital murder charges and a potential death sentence for Kirk's murder at Utah Valley University on September 10.

But his defense attorneys now argue that the Bureau of Alcohol, Tobacco, Firearms and Explosives 'was unable to identify the bullet recovered at autopsy to the rifle allegedly tied to Mr Robinson.'

The defense team may now offer the ATF firearm analyst's testimony as exculpatory evidence, they said in a motion filed on Friday to push the preliminary hearing back at least six months, Fox News reports.

'The defense team has devoted, and will continue to devote, significant resources, to processing discovery, including identifying materials not yet received to inform readiness for the preliminary hearing,' the filing states.

'However, the defense team is realistic and the comprehensive review required to determine what is missing will take hundreds of hours.'

'What is known at present is that Mr Robinson has not yet received the forensic case files and data necessary to investigate, through the use of qualified experts, the scientific reports the state intends to introduce at the preliminary hearing,' the attorneys continued.

His attorneys have previously noted that pretrial publicity reached as far as the White House, with President Donald Trump saying shortly after Robinson's arrest that he hopes 'he gets the death penalty.'

They are now expected to show evidence at the hearing they believe contains 'harmful and prejudicial media coverage of this case thus far.'

Only one bullet was fired at Charlie Kirk, and he was killed by its impact.

Perhaps Robinson was a plant to confuse and to distract and the real assassin escaped without ever being noticed and could have possibly been associated with law enforcement or another nefarious hate group. Robinson’s escape from the rooftop didn’t show that he had a rifle. The rifle was likely stashed in a nearby location for easy retrieval. Without compelling evidence, Robinson will likely beat the charge.

I was dealing with my husband’s mal treatment in acute care and eventual death on August 5th last year, so I was completely devastated by Charlie Kirk;s murder shortly after. I was like a zombie and not relating to anything…still dealing with this.
Then I see all of this crappola from Candice, a person I had admired. I am completely GOB-SMACKED by what is coming out if her mouth these days! Maybe she suffered an aneuryism?
Truly disturbing.

In case younger FReepers don’t know. The controversy over the 1963 Oswald weapon.

1) Paraffin tests conducted on Lee Harvey Oswald after the JFK assassination yielded mixed results: his hands tested positive for nitrate residue, but his right cheek tested negative. These results are often debated, as paraffin tests (popular at the time) were known to produce false positives from substances other than gunpowder, such as tobacco or cosmetics, making them unreliable.

That is the least logical explanation. The most likely is the projectile was just too damaged to confirm or exclude the connection to the weapon.

A Hail Mary from the defense. They’re hoping there are enough kooks out there who believe it was impossible for Kirk to have been shot with a 30-06 that they’ll be able to get a few on the jury. This feeds into that.

They will get him for conspiracy and perhaps murder even if he wasn’t directly the shooter but connected. If his actions caused misdirection away from the real killer, Robinson would still have been involved with the plot and there-for just as guilty.

Rifle bullets, even when fired into water traps, are the most difficult bullets to match. Such bullets in this case are probably fragments. (Which doesn’t make a match any easier).

I retired from the business of bullet-matching, which Obama has since conducted lawfare against, using taxpayer money.
