Fact check: Could a President Beto O'Rourke confiscate assault weapons?

Former Rep. Beto O'Rourke of Texas has made his position on assault weapons crystal clear. "Hell, yes, we're going to take your AR-15, your AK-47," O'Rourke said during Thursday's Democratic presidential debate. "We're not going to allow it to be used against our fellow Americans anymore."

To accomplish this, O'Rourke has proposed a mandatory confiscation of these guns whereby individuals would be compensated for their firearms.

Beyond the thorny politics of this proposal, it raises clear legal and logistical questions, including whether a president has the authority to confiscate people's guns.

Facts First: A president could not issue a blanket confiscation of so-called assault weapons, but they could work with Congress to pass such a law. Constitutionally speaking, that law would likely run into some significant legal trouble.

First, some basic facts. The National Rifle Association has estimated that there are somewhere between 8.5 million and 15 million assault rifles in the US, the organization told McClatchy in 2018. That's about 2% to 4% of all the estimated guns in the US, but it's unclear how many guns would ultimately fall under an assault weapons confiscation.

I believe any confiscation “law” would be an unconstitutional ex post facto law.

I wonder if we will see another Democratic ticket with two white non-Latino “cisgender” heterosexual males again. I wouldn’t be surprised if Newsom runs for President...but he would face a lot of pressure to have a woman or a “person of color” as the VP nominee.

And then there is virginia who recently granted the right to 18 to vapers and then took it away with no grandfathering. So anything is possible these days.

They made it difficult on purpose.

We found out to our dismay in 2008 that changing it can sometimes be as easy as confusing people about the clear meaning of a three word phrase when both parties and the Ministry of Propaganda shout down those who know what natural born citizen means.

Alinsky would have been proud.

My all time favorite regarding Beto, is when confronted about the absolute minuscule amount the ASSHAT has given to charity, he stated, that he has given plenty by serving in political office HA, HA, HA, LOL,LOL,LOL!!!! OMG what an ARROGANT SOB!!!!

We need one more Supreme Court justice who has a record to prove his support for the Second Amendment. Otherwise, if we allow a politically correct choice (e.g., for feminism), the U.S.A. may well be finished.

I tend to think there is this romanticized vision that the gun-owning public would create insurrection. Personally, I don’t buy it. Take the border for example. The government has successfully repelled American patriots from guarding the border on their own, allowing millions and millions of illegal invaders to come in and steal from American citizens. They steal resources, facilities and healthcare from us. Did civil war break out? No.

Are we to look at Bundy Ranch for an example? I think in the end, the government ended up winning that one didn’t it? I’m hoping not to provoke flames, people get real sensitive about their guns, but this requires some thought beyond ‘we have 150 million vs 120,000 feds’.

I don’t think confiscation would be a nationwide simultaneous front that opens, like you said, they don’t have the raw numbers. But let’s not kid ourselves, the government probably has a plan in place right now, and they probably have high value targets that they would go after first, to make an example of. The government knows everything, they spy on us all the time, they monitor every text and every phone call. They monitor this very post. If the feds want your guns, they will go WACO on you. And don’t underestimate the patience of the left, they have spent the last century advancing their progressive agenda, slowly wittling away the constitution, one small victory at a time.

I don’t trust the local police and sheriff’s departments to protect us either, after all, they have pensions, homes and health insurance to protect. They will follow orders.

Yes, actually they do. They will proceed just as we have seen throughout history. They will show up unannounced at odd hours and be outside your home with a large tactical team armed to the teeth with machine guns and body armor. In addition they will keep the extent and frequency of these activities secret. They will slowly add more and more excuses to flag anyone who is armed to the extent they will eventually target everyone. So yes they do have an advantage, in fact they have EVERY advantage except the number of personnel. Yes we have a 150 million armed Americans but how are they organized to fight a tyrannical central government? The federal government has the capability of nation wide gun confiscations right now with a massive unconstitutional military police force just waiting for their orders. So we had better wake up and realize while we might be safe from truly dangerous politicians like Beto at the moment, the threat of the massive weaponized bureaucracy will remain ever present and waiting unless we insist it be dismantled. We must assume at some point someone a little better polished but with the same insane political ambition as beto frances will get into the White house. We must make certain they don't have the tools of tyranny at their disposal.

Given the size of those units you project and the infrequency of their "visits" it should only take them 150-300 years to confiscate the first million ARs.
