If A hits B and B then intending to hit A but hits C instead, then if B would have been justified in hitting A, B will not be criminally liable for hitting C even though C was innocent. However, if B was not justified in his response, then B will be both potentially liable criminally and civilly to C.

Thus, if Artest would have been justified in hitting the actual fan that threw the cut, then he will not be liable to the actual fan he hit regardless of the innocence of such fan (but his mistaken identifying of the fan must be a reasonable mistake).

In this case, however, Artest faces an uphill (but not impossible) climb of arguing self-defense and thus will likely be liable to the innocent defense.

I don't think basketball is any sleazier than the other sports. Football may have more violent crime than the major American sports, but I think in general there's not too much difference to find between football, baseball basketball and hockey.

There's plenty of good moral guys playing in the NBA. I'm not a fan of the pro version of the game, but people like Dwight Howard and Alan Houston of the Knicks are good people. I haven't heard anything bad about the Pistons' Tayshaun Prince in the years I've followed his career. It's overlooked that most of the players at the game last night did nothing wrong. Even Rasheed Wallace of bad reputation was trying to calm things down.

I'm a fan of the Tennessee Vols and it pains me to think that fine people like C J Watson, Stanley Asumnu and Chris Lofton might be dismissed as thugs just cause they are black guys who play basketball. I'm sure fans of most team s in the country also have players they can be proud of both on and off the court. I agree that the gangsta element that has attached itself to the image of basketball is not good, but I'd say the thugs are in the minority. When you don't follow a sport, the thug minority will be the ones always gertting the attention.

ESPn attacked the fan that Artest attacked this morning. He should sue them for defamation. He was innocent. He did nothing.

What were the fans in that area supposed to do, let Artest beat up this guy? Just sit there and look at the floor while Artest killed the guy.

ESPN has been pathetic in all of this.

No. That is Rick Mahorn. The former Bad Boy was actually trying to help break things up.

The NBA has been awesome in the speed and depth of its decline. No fun to watch as sport and participants who are glorified for their gangsta attributes.

I would rather watch a church burn than an NBA game.

Back in '83 I believe, at Joe Lewis eastern playoff, Boston and Detroit, Lambier was coming up the floor after a basket, and Robert Parrish wheeled around an DECKED Lambier with a haymaker. For some reason I'm smiling remembering that incident.

What in the world was Artest DEFENDING himself from? He wasn't defending -- he was RETALIATING. The police/security are supposed to handle the cup thrower. Not Artest.

Oh gosh, you've given them too good an idea. Phil Mushnick is not going to be happy with you.

You should have your people call their people, they'll love this. OJ could even host a show. That way the families of the two people he murdered can get some of the $ he owes them.

Only Johnny Crackring would argue that Artest acted in self defense. "If the beer cup flies, the thrower dies!"

Seriously though, look at the guy he attacked. What, maybe 5' 10, 150# tops? Where is the additional "danger"? And even if there is additional "danger" does its threat rise to the level that justifies the response by Artest?

He clearly crossed the line here and he'll pay.
