The Department Justice is opening a criminal investigation into its own Russia probe. A new report from The New York Times said officials have shifted the Russia investigation overseen by Attorney General Barr from an “administrative review” into a criminal investigation. The move gives U.S. attorney John Durham the power to subpoena for witness testimony and documents. DOJ rules state that a criminal inquiry can only be undertaken after finding a “reasonable indication” of wrongdoing. The intent of the investigation will be to uncover the origin of the Russia probe, but it is not clear what potential crime Durham is...

House Intelligence Committee chairman Devin Nunes has issued a subpoena to David Kramer, a former State Department official who, in late November 2016, traveled to London to receive a briefing and a copy of the Trump dossier from its author, former British spy Christopher Steele. Kramer then returned to the U.S. to give the document to Sen. John McCain. Kramer is a senior fellow at the McCain Institute for International Leadership at Arizona State University. McCain later took a copy of the dossier to the FBI's then-director, James Comey. But the FBI already had the document; Steele himself gave the...

Lead Benghazi investigator looks to correct inaccuracy from Clinton’s first interview Hillary Clinton told CNN on Tuesday that she was never personally subpoenaed. Rep. Trey Gowdy (R., S.C.) says that is simply false, and on Wednesday he released the documentation proving it. Clinton was personally subpoenaed as part of an investigation into the 2012 attacks on U.S. diplomatic facilities in Benghazi, Libya, according to a copy of the subpoena released by Gowdy’s office. She was ordered to turn over emails to or from her personal email accounts, which she used to conduct official State Department business. “The committee has issued...

WASHINGTON (AP) — A House subcommittee on Wednesday authorized a subpoena against the Homeland Security Department for information about illegal immigrants who have been identified but not deported. The authorization cleared the House Judiciary subcommittee on immigration policy and enforcement by a 7-4, party line vote. Democrats voted against the measure, saying it was premature to issue a subpoena because Homeland Security, which oversees Immigration and Customs Enforcement, is cooperating with the committee. House Judiciary Chairman Lamar Smith, R-Texas, says the subpoena authorization is necessary because the Obama administration hasn't responded quickly enough to his request, which was made in...

A Documentary Critical of the California Coastal Commission Under Attack June 17, 2009 - A filmmaker who is producing Sins of Commission, a movie critical of the California Coastal Commission’s infringement on private property rights, was served a subpoena by the commission to acquire raw footage of the film before its final release! Claiming that this intimidation is an attack on his 1st Amendment Rights, the filmmaker is going public. This legal tactic comes as no surprise to property owners who have dealt with a commission who has denied them the ability to make even the most modest improvements to...

WASHINGTON - Before he ran for president Barack Obama quit smoking. Now that he's won the job, he may have to break another addiction: Checking his BlackBerry for e-mail. The president's e-mail can be subpoenaed by Congress and courts and may be subject to public records laws, so if a president doesn't want his e-mail public, he shouldn't e-mail, experts said. And there may be security issues about carrying around trackable cell phones

Congress and the Bush administration could still save Terri Schiavo – if they would simply enforce legal subpoenas that were issued last week demanding that Congress be allowed to interview Terri and others in the controversial matter. Those Congressional subpoenas, however, have been wantonly ignored by a Florida state judge and local authorities in a brazen act.

WASHINGTON (AP) -- The independent commission investigating the Sept. 11 attacks will not relent in its pursuit of public testimony from the president's national security adviser but is unlikely to subpoena Condoleezza Rice, the panel's chairman said Sunday. The former chief counterterrorism adviser at the White House, who has criticized the Bush administration's preparedness for the attacks, said he would welcome the attempt by leading Republicans to declassify 2-year-old congressional testimony. The lawmakers hope to show discrepancies between Richard Clarke's recent attacks on the administration's terrorism policies with flattering statements he made as a White House aide. The White House...
