These courts should change the style of their robes; they can keep the black, but they should emblazon the Jolly Roger in a prominent place. They have become little more than pirates, after all. Timothy Birdnow image By Timothy Birdnow —— Bio and Archives March 20, 2017 0 Comments | Print Friendly | Subscribe | Email Us It has been rightly pointed out by a number of individuals that Federal law gives absolute authority to the President of the United States in matters of immigration and determinations of the national security implications of said immigration and travel. Despite this fact,...
  • GOP JUDGE PAVES ROAD FOR THOUSANDS OF POTENTIAL NON-CITIZENS VOTING IN KANSAS

Despite news percolating throughout the country about non-citizens registering to vote under loose Motor-Voter practices, the courts are refusing to allow states to verify citizenship as a condition for registering to vote. Yesterday, the Tenth Circuit Court of Appeals upheld a district court’s injunction against a Kansas law requiring those registering with federal Motor-Voter forms to show proof of citizenship. The original injunction forced the state to register 20,000 individuals who failed to show proof of citizenship. Now, that number could rise to 50,000.
  • 7 FAM 1130 ACQUISITION OF U.S. CITIZENSHIP BY BIRTH ABROAD TO U.S. CITIZEN PARENT (Scrubbing of 7

Today I discovered that the reason I could not find a section of the Nationalization Statues is because the section had been scrubbed. This is not an accident. The section removed had confirmed that the interpretation of the State Department based on the Constitution and relevant case law was that Naturalization did not convey natural born status for Constitutional purposes. The Foreign Affairs Manual (FAM) and associated Handbooks (FAHs) are a single, comprehensive, and authoritative source for the Department's organization structures, policies, and procedures that govern the operations of the State Department, the Foreign Service and, when applicable, other federal...

Do you remember Lewis "Scooter" Libby? In 2003, the Department of Justice appointed a special counsel to investigate allegations that Libby, Vice President Dick Cheney's chief of staff, unlawfully disclosed the covert status of CIA operative Valerie Plame. Yet Plame may not have been a covert undercover agent, based on the formal government definition of that role. And even if she were, it was widely known at the time that Secretary of State Colin Powell's subordinate, Richard Armitage, had most likely disclosed her status earlier. In other words, Libby was in an Orwellian position of being accused of a crime...
  • Kim Davis’s gay marriage issue is legally different than sanctuary city refusal of fed immigration

Full Title: Why Kim Davis’s refusal to issue same-sex marriage licenses is legally different from a ‘sanctuary city’s’ refusal to cooperate with federal immigration law Many commentators have sought to draw an equivalence between Rowan County, Kentucky clerk Kim Davis’s refusal to issue same-sex marriage licenses, in defiance of a federal court order, and the decision of so-called “sanctuary cities” to refuse to enforce federal immigration laws. Yet as a legal matter, the questions presented by the two scenarios are quite distinct. Put directly, Kim Davis is acting in defiance of applicable federal law; sanctuary cities are not — and...

Matthews: No one enforces immigration law because they want cheap labor - and votes for Dems Obviously, we’re used to a steady stream of crazy coming from the fine folks at MSNBC. Chiefest among the network’s primetime calamities is Chris Matthews, whose career is basically one, long, barely-coherent rant. Every now and then, though, it feels like one of his handlers stuffs his meds into a wad of peanut butter and Chris comes through with something approaching an actual truth. President Barack Obama speaks on the fifth anniversary of his healthcare law, Wednesday, March... This week President Obama took unilateral executive action — again — to change the nation's immigration laws. Almost no one noticed.Obama intends to make it easier to bring more foreign guest workers to the United States — likely at significant cost to workers already here — by loosening the rules governing something known as the L-1B visa program. Under the program, a multinational company with offices in the United States can move workers from abroad to live and work in the U.S. for as long...

If federal law enforcement officers apprehended a person who had been using a false Social Security Number, a federal prosecutor with a heavy caseload dominated by more serious crimes might decide not to indict the person. Whatever its merits, that would be an act of prosecutorial discretion. But what if the prosecutor were to tell this user of a false Social Security Number: It is okay for you to continue using that false Social Security Number tomorrow. In fact, you may do so with impunity for the next three years. Would that be an act of prosecutorial discretion? Or would...

As Republicans work to overcome a Democratic filibuster of a House-passed Department of Homeland Security bill that blocks President Barack Obama’s executive amnesty, Sen. Jeff Sessions (R-AL) is highlighting the Obama administration’s long history of dismantling immigration laws. In a lengthy timeline released Monday, Sessions — the chairman of the Subcommittee on Immigration and the National Interest — lists every instance of the Obama administration ignoring, rewriting, delaying and breaking the nation’s immigration laws. The timeline begins in January 2009 with the administration ending worksite enforcement actions and, 50 pages later, ends on February 13, 2015 with the House Judiciary...

White House attorneys are examining whether the president can use executive action to “level the playing field” on immigration for business owners, press secretary Josh Earnest said Monday. Earnest provided few details about what kind of action the president might take, but the comments offered the first insight into what type of authorities the administration was reviewing following the president's announcement he would look to act unilaterally after comprehensive immigration reform legislation died in the House. “The question is whether or not there are additional steps that you can take to level the playing field for businesses,” Earnest told reporters....

Although the conversation on immigration reform tends to unfold in terms of border security, enforcement of laws, and pathways to citizenship – there is one critical aspect this debate that has failed to break through all of the other noise. Immigration reform could help the economy grow--if done the right way. Instead of getting bogged down in negotiations about amnesty and its various forms, conservatives should drive the conversation toward STEM (science, technology, engineering, and math) and H1-B visas. These visas can help bring the world’s best and brightest to America--the kind of people who will start businesses, buy...

Amid Hispanic calls for immigration leniency, the U.S. Immigration and Customs Enforcement Agency is scrapping a program that allowed specially trained state and local law enforcement officers to enforce federal immigration law. On Dec. 21, the Friday before Christmas, ICE announced that it has decided “not to renew any of its agreements with state and local law enforcement agencies that operate task forces under the 287(g) program.” ICE said it has concluded that “other enforcement programs, including Secure Communities, are a more efficient use of resources for focusing on priority cases.” …

The United States Supreme Court struck down some parts of the Arizona Immigration Law, but the Supreme Court UPHELD a key provision (and very controversial part) of the AZ Immigration Law. According to the Washington Post, The Supreme Court has upheld the provision in the AZ law requiring police to check the status of someone they suspect is not in the United States legally. A federal judge on Thursday blocked three key provisions of South Carolina's controversial law cracking down on illegal immigration. U.S. District Judge Richard Gergel granted the federal government's request for an injunction against the law that's set to take effect Jan. 1. The ruling applies to portions that require law officers to check the status of anyone they stop for something else and suspect is in the country illegally. Gergel also halted the implementation of sections pertaining to the transportation of illegal immigrants and immigrant registration cards. Gergel has denied the state's request that he suspend all court hearings

A federal judge on Monday heard arguments on a request by civil liberties groups to block Georgia's law cracking down on illegal immigration from taking effect until a legal challenge is resolved, but said he would not make an immediate ruling. The groups have filed a lawsuit asking a judge to find the law unconstitutional and to prevent its enforcement and also filed a request that the judge block the law from taking effect until that lawsuit is resolved. U.S. District Judge Thomas Thrash heard arguments from lawyers for the groups and from a lawyer for the state who said...

Alabama's new law cracking down on illegal immigrants will likely survive legal challenges from advocacy groups that say it is unconstitutional and racist, analysts told Fox News. The law, which takes effect Sept. 1, empowers police to arrest people suspected of being an illegal immigrant if they are stopped for another reason and requires businesses and schools to verify whether workers and students are in the country lawfully. It also makes it a crime to knowingly transport or shelter illegal immigrants. As soon as Republican Gov. Robert Bentley signed the bill into law Thursday, the ACLU and Southern Poverty Law...

On May 26, 2011 the Supreme Court of the United States sustained the law that penalizes businesses for hiring illegal immigrants. In a ruling that will affect Tucson as well as the State of Arizona, the Court rejected the arguments that states have no role in immigration matters.
