  • Ninth Circuit Puts An End to the Kids Climate Case

Today a unanimous panel of the U.S. Court of Appeals for the Ninth Circuit granted the U.S. Department of Justice's petition for a writ of mandamus seeking dismissal of Juliana v. United States, the so-called "Kids Climate Case." The brief order was short and direct. It noted that the Ninth Circuit had previously concluded that the plaintiffs lacked standing and ordered the case dismissed. Contrary to the plaintiffs' claims, no intervening decisions changed that fact, and that there was no basis for the district court to allow the plaintiffs to amend the complaint. This decision should not have been a...
  • Kentucky resolution would defy EPA fossil fuel regs like ‘sanctuary cities’ do for immigration

Republicans in the Kentucky House are proposing a resolution that would create “a sanctuary state” for fossil fuel-powered generators. The resolution, which was assigned to a committee Wednesday, appears to be modeled after the concept of “sanctuary cities,” which are local jurisdictions that have agreed not to comply with federal immigration regulations. The resolution aims to exempt Kentucky from EPA regulations regarding coal- and natural gas-fired power plants. Permitting for such facilities would be done by the state, and Kentucky agencies would be prohibited from collecting fines or penalties for violations of federal regulations related to fossil fuel-fired power plants.

The California Trucking Association is suing the state’s air-quality agency over a new climate action rule that requires truckers to switch to zero-emissions vehicles by 2042, claiming it “threatens the security and predictability” of the trucking industry. In a federal lawsuit filed against the California Air Resources Board (CARB) Oct. 16 in Sacramento U.S. District Court, the trucking association is seeking the court to permanently stop the agency from enforcing its Advanced Clean Fleets rule that goes into effect Jan. 1. The proposed regulations (pdf) would require trucks operating at California ports to be zero-emission by Jan. 1, 2035, and...

Oil prices reached a nine-month high amid concerns about tight oil supplies after Russia and Saudi Arabia extended supply cuts. Brent futures, a global benchmark to measure oil prices, rose to $91.01 a barrel on Friday, according to MarketWatch, and sits at $90.44 a barrel as of Sunday morning. Prices had already surged last week after Riyadh and Moscow agreed to extend supply cuts beyond October. The U.S. banned Russian oil imports last year, but Russia and Saudi Arabia respectively produced 11% and 12% of the world's oil last year, according to the Energy Department, so any changes in production...

A research document published on the White House's website reveals the Biden administration is open to studying how to block sunlight to save the earth from climate change. The congressionally mandated report released by the White House Office of Science and Technology Policy on Friday shows that the team has been researching "geoengineering" methods to keep the sun rays from accelerating global warming. As the University of Oxford notes in its entry on the subject, "geoengineering" is "the deliberate large-scale intervention in the Earth’s natural systems to counteract climate change." According to the report, titled "Congressionally-Mandated Report on Solar Radiation...

MELLETTE, S.D.—On their way to attend their niece’s wedding in July 2021, fourth-generation farmer Ed Fischbach of Mellette, South Dakota, and his wife made a quick stop to check the mailbox. His wife reached inside, pulling out a handful of letters. Within the small pile was an envelope from a company she had never heard of—Summit Carbon Solutions. She opened the letter and began reading it. “Dear landowner,” the letter began innocently enough. But as she continued reading, her jaw nearly dropped. “Listen to this,” she told her husband. The Iowa-based company described plans to build a massive carbon capture...

Two Just Stop Oil protesters who scaled a bridge on the Dartford Crossing, forcing police to close it to traffic, have been sentenced to more than two and a half years each for causing a public nuisance. Morgan Trowland, 40, and Marcus Decker, 34, used ropes and other climbing equipment to scale the Queen Elizabeth II Bridge, which links the M25 between Essex and Kent across the River Thames, in October last year. The police closed the bridge to traffic, causing gridlock. Trowland was sentenced to three years in prison, while Decker received two years and seven months. Spokespeople from...

A group of liberal Democrats reintroduced the Green New Deal Thursday, the controversial environmental legislation that experts say would spike energy costs in the U.S. and cost taxpayers tens of trillions of dollars. Advocates, though, argue the changes are needed to prevent worsening climate change and get ahead of an inevitable renewable energy transition. “For so long, our movement towards a sustainable future has been divided with really just this false notion that we have to choose between our planet and our economy,” U.S. Rep. Alexandria Ocasio-Cortez, D-N.Y., said at a news conference Thursday. Ocasio-Cortez has largely become the face...

More states around America are moving toward mandating the use of electric vehicles in an effort to “end fossil fuels.” But all of those vehicles have to be recharged on a regular basis. People with the ability to do so have primarily been charging their vehicles at home with slower Level 1 or Level 2 home chargers using a household outlet. But people living in some apartments don’t have that option and people who regularly take longer trips have to rely on the availability of commercial Level 3 fast chargers. The Boston Globe recently conducted an investigation to find out...

Over the last year, the green tyranny bureaucracy of the EU has managed to nearly destroy Western Europe's energy relationship with Russia, leaving the continent desperate for energy inputs to keep its power grid functioning. Now, the food supply of Europe is under direct assault via multiple schemes that seem designed to end affordable food at the same time electricity is becoming unaffordable for businesses and residential households alike."Germany bans farmers from properly fertilising land to serve EU green agenda," declares Breitbart.com. "As of Thursday, the use of nitrate fertilisers has been greatly restricted for large swathes of farmland in...
