U.S. Supreme Court Justice Ketanji Brown Jackson argued that it is “cruel and unusual” to punish unhoused individuals for sleeping in public spaces.
“We’re talking about sleeping … that is a basic function,” Justice Jackson said during Monday’s oral arguments in a case that could result in the criminalization of homelessness.
On Monday, the Supreme Court heard more than two hours of arguments in the case of Grants Pass v. Johnson. The justices listened to both sides of the case to determine whether cities across the nation are violating the Eighth Amendment and engaging in “cruel and unusual punishment” by placing restrictions on where unhoused individuals can rest.
While the liberal justices opposed criminalizing members of the unhoused community, the conservative majority considered an argument from attorneys representing Grants Pass, which is that the decision to punish homelessness should be left to local governments, not the justices.

Well, going to the bathroom is a “basic function,” but we have laws that limit where you can do that. (Seem to be no limits in some blue cities, though.) Let’s get some homeless people (excuse me, “unhoused”) to show up at Jackson’s home where they can sleep and also relieve themselves in her yard, and she can get a double whammy of people freely practicing “basic functions.”
Okay then. Just the ‘criminals’ of the homeless should definitely be criminalized and brought to justice, that won’t happen with this biased administration/America haters..

Incarceration is expensive, and in this case not much of a deterrent. No reasonable person wants tent cities, but municipal authorities have limited options dealing with people who’ve chosen vagrancy as a lifestyle.

I’m for the status quo.
The lavish welfare blue states are doing the nation a service by being a leading importer of the mentally ill and/or homeless.
They’ll spend insane money to solve a problem that they themselves in part created.
Eventually they’ll be bailed out in part with federal dollars.
In the meantime, they are the homelessness epidemic states by choice. Every Polynesian in Hawaii had a hut. It took Democrats to create an homelessness epidemic in paradise.
I thought SCOTUS ruled against vagrancy laws in the early 60s. DC had no laws against it when I was there.

Property values and taxes went sky high, rents had to follow and people can’t afford rents or even property.
The retirement is fixed so if they retired, the fixed income doesn’t keep up with costs.
As far as addiction. That’s a real problem since these people are constitutionally protected like the rest of us.
They put them into shelters, they have a time limit on the stay and then they must move on.

The people living on the street are vagrants. Vagrancy is a crime. Vagrants have no right to occupy public spaces. This is a no brainer.

No one is trying to criminalize homelessness. Cities simply want the ability to force people out of certain areas that are using them inappropriately.
Someone needs to drop off a buss load of homeless on her homes front lawn! Then she will understand what cities want the power to do!

The only ones not making money of the homelessness racket are the tax payers.
When cities and states pass a bill for the money it gets passed down to a distribution out fits it’s why they never know where the money goes.
Lack of housing, water shortage, streets full of garbage, increase in crime, caused by the government importing people who cannot support themselves
I am simply aware that most social research is bogus and that includes homeless studies.
The like to plump the numbers of the most sympathetic portions of the population to better engage with fundraising.
Most homeless claiming to be vets are not. This has been true since Vietnam.
It seems to me that cities/towns/municipalities need to set aside space where the homeless can park rather than on sidewalks. The trash and messiness is horrible, but we havè to accept that the homeless exist, always have, always will. Their numbers are growing.
And yes, they need toilets, showers and trashcans, access to water. All humans do.
Most of these people are sick, and most want to keep to themselves. Our society is changing for the worse and will only get worse. Like it or not, that’s the way it is.
