Andrew McCabe, a former acting and deputy FBI director who had drawn the ire of President Trump, was fired by Attorney General Jeff Sessions late Friday evening, a decision that raises troubling questions about the independence of both the Justice Department and the FBI.

None of the executive branch main departments are “independent”. Their leaders make department policy and their leaders are selected by the president. From the president, down to the appointed leaders, down to the managers they hire, down to the staff. It is not “independence”, it’s a chain of authority that starts at the top.
The myth, as the Progressives intended, that the agencies are “independent” was NOT to shield the agencies from politics, which the chief executive uses as much as anyone, but to shield them from representative government, to create a branch of government - the regulatory state - that is not controlled by the representative government - government elected by the people.
You can see this when the Left has never complained about executive overreach generated from the politics of a president they favor. That was OK (like with Obama) because Obama’s politics was put into the state power of the regulatory state. That did not make them “independent”, in fact the DOJ was subservient to Obama’s politics more than any president since FDR.
But the regulatory state and their fellow travelers in the media did not complain about Obama’s politics on them, because he invested his politics in their power, against the law and the Constitution at times. They applauded. They did not write articles against “loss of independence” from the president.
Its a maaaad house...a maaaadddd houuuse!!!
All good questions. The answer? They like being answerable to themselves, not the American people.
Drain the Swamp.
I think Wray told McCabe to step down as number 2 around the time of the memo release. McCabe said OK, I'll take terminal leave and retire. Maybe he deserved to be fired then, but he couldn't until certain administrative steps were taken. If he had 5 star performance reports from Comey, they can't just fire him. They have to build a case against a career civil service type.
Title should be: McCabes Firing Chips Away at the Justice Departments Illegal Control of the USA
Just get the details on Adam Serwer and you have the explaination for his motivation and his animus.
McCabe has guns and he is pissed. The FBI better disarm him. Hes made threats about taken down the organization.
Neither the Justice Dept nor the FBI are mentioned in the Constitution. What IS mentioned is (Article II, Section 3) "...he shall take Care that the Laws be faithfully executed,"
It is the President's constitutional duty to ensure that the laws are faithfully executed. He may delegate the job to others, but the duty remains exclusively his.
Now, if he takes down all his pals then he will be considered quite useful to us.
At least some will start thinking "If McCabe can lose his pension over lying to Congress, then that means I might be at risk too".
Independence from WHAT, exactly?
Who is it that is REQUIRED by the Constitution to "take care that the laws be faithfully executed"?
Therefore, who is IN CHARGE OF the DOJ and the FBI?
The upper 1/3rd of all political bureaucracies, both state and federal, are NOT independent. Let’s end that lie right now.
The senior levels are appointed by politicians and hence owe their personal allegiances to the political power blocks who hired them, first and foremost.
The mid level bureaucrats owe their personal allegiances to the political power blocks within their respective bureaucracies.
The events since the 1960s have identified those two truths and the events over the last 18 months have written those truths in big, almost bloody, red ink on every bureaucratic monument to political power.
Proof of statement - how many politicians running for election have promised to clean up the existing bureaucratic messes? How many of those politicians have repromised to clean up the existing bureaucratic messes when standing for re-election? How much cleaning has actually be accomplished to date?
“Independent” bureaucracies my Aunt Melba’s rosy red @#$*&^ !!
The FBI is NOT an independent agency. It is an agency which is part of the US Department of Justice. The director of the FBI reports to the US Attorney General.
The FBI is a police agency. I wonder if any of the morons who are claiming the FBI needs independence would argue that the police department in their cities should be independent of (1) the mayor of that city, (2) the city prosecutor of that city, and (3) the city council of that city. Police Chiefs are routinely fired in this country for questionable activities.
The FBI brass (balls) types should be fired whenever they engage in questionable activities. When they violate the law, they should be indicted and tried. If they are convicted they should be given the maximum sentences allowed by law.
Both Comey and McCabe are attorneys. They should have known the law. They chose to put themselves above the law. The law should now crash down on both of them to remind other attorneys and “police” officers that they are NOT above the law.
I believe ‘independent agency’ for the federal government just means it is authorized on its own by Congress.
For example, the official list of fed ‘independent agencies’ shows the CIA but not the FBI:
https://www.usa.gov/independent-agencies
No, allowing a cat like this to cash in would be proof of no independence in DOJ.
The swamp is getting scared because all of a sudden, those who considered themselves “untouchable” are feeling the fingers of Justice start to run its fingers over them....
Agreed, as it would normally be the responsibility of the Director to terminate - Wray
Of course, Comey took unprecedented responsibility with his famous news conference when he laid out a perfect case to indict Hilary and then said failed to do so.
I’ve been told he lost the rank and file FBI agents at that time and that is, in my opinion, is when Comey should have been fired. But then again look who was the POTUS and who was heading DOJ.
So this author finds someone who engaged in inappropriate and possibly illegal conduct being fired for cause "troubling" but not the inappropriate and illegal conduct?
Unfortunately millions of people read and hear crap like this and believe it.
