McCabe’s Firing Chips Away at the Justice Department’s Independence

Andrew McCabe, a former acting and deputy FBI director who had drawn the ire of President Trump, was fired by Attorney General Jeff Sessions late Friday evening, a decision that raises troubling questions about the independence of both the Justice Department and the FBI.

What they mean is, they don't like their little oligarchy having to answer to the people, through their representatives.

The Justice department IS NOT SUPPOSED to be independent, like the Supreme Court, free from the influence of elections.

The executive establishment IS NOT a check to the president. That is their misguided view, since Watergate.

So, the DOJ, which is the boss of the FBI, independently decides to fire one of its own. And this is a threat to its independence?

The Hatch Act:

Provisions[edit] The 1939 Act forbids the intimidation or bribery of voters and restricts political campaign activities by federal employees. It prohibits using any public funds designated for relief or public works for electoral purposes. It forbids officials paid with federal funds from using promises of jobs, promotion, financial assistance, contracts, or any other benefit to coerce campaign contributions or political support. It provides that persons below the policy-making level in the executive branch of the federal government must not only refrain from political practices that would be illegal for any citizen, but must abstain from "any active part" in political campaigns, using this language to specify those who are exempt:[7] (i) an employee paid from an appropriation for the Executive Office of the President; or (ii) an employee appointed by the President, by and with the advice and consent of the Senate, whose position is located within the United States, who determines policies to be pursued by the United States in the nationwide administration of Federal laws. The act also precludes federal employees from membership in "any political organization which advocates the overthrow of our constitutional form of government,"[8] a provision meant to prohibit membership in organizations on the far left and far right, such as the German-American Bund and the Communist Party USA.[9] An amendment on July 19, 1940 extended the Act to certain employees of state and local governments whose positions are primarily paid for by federal funds. It has been interpreted to bar political activity on the part of employees of state agencies administering federal unemployment insurance programs and appointed local law enforcement agency officials with oversight of federal grant funds. The Hatch Act bars state and local government employees from running for public office if any federal funds support the position, even if the position is funded almost entirely with local funds.[10] The Merit Systems Protection Board and the Office of Special Counsel are responsible for enforcement of the Hatch Act.[11]

Little overblown??

McCabe was resigning...but decided he was going to wait until he was 50 so he could draw an early pension.

I'm gonna make a bet that he was tutored by Comey for this step by step plan.

The guy set himself up.

Got duped by his own brother.

The New Atlantic is a perfect example of the fact that journalists are totally unfamiliar with the right side of the Bell Curve.

The justice system is anything but independent. Bush/Clinton/Bush/Obama saw to that. The undercurrent of the Obama Administration was the profound change that came about within the justice system culminated through Obama’s administrative efforts. Holder and Lynch profoundly changed the American justice system in ways that we are only beginning to unravel. the ganglion roots of Obama, Holder and Lynch (along with Comey at el) go deep. This is not America per our constitution.

Considering that in this case the government (no a political party) was engaged in subverting the election, and that beyond that the government was providing material support to terrorists, I'd say yeah, this is a bigger deal.

A most welcome revelation, if you ask me. If Hillary had won, none of this would have come to light.

As I recall, it is the FBI who called for McCabe’s termination, not the president. The only question I have is; why didn’t the FBI do the job? Or, at least suspend him and seek guidance from DOJ noting McCabe was a hot topic.

I believe that they are referring to the Justice Department’s being independent from the Constitution and the Rule of Law.

I wondered why Wray didn’t fire McCabe. It seems like he let this go the route it has so that the blow back would fall on Sessions and Trump.
