Federal judge defies Trump admin, removes Pentagon block on funds for gender reassignment

A federal judge in Maryland became the second to block the Trump administration’s proposal to oust transgender service members from the military — but went a step further than the prior ruling and halted a directive for the Pentagon to stop paying for gender-reassignment treatments.

The preliminary injunction issued Tuesday by U.S. District Judge Marvin J. Garbis comes after the prior ruling out of D.C. found that the policy banning transgender troops creates an “inherent inequality” that likely violates the Constitution.

Judge Garbis wrote in his 53-page order that transgender military members who filed suit over the proposal had established that they were “likely to suffer imminent harm as a result of the Directives in the President’s Memorandum.”

No, but the zombies are piling on. He’s at war with both parties and the GOP has made themselves almost un-reelectable now so in 2018, Trump’s slides will lock back on empty mags.

I don’t know if the Progs are geniuses or the biggest idiots in human history because you are exactly right. There’s no co-equal. Each branch has an enumerated role under the Constitution. The reasons why we have oaths to uphold and defend it.

These judges are outside their roles and tearing what’s left of our constitutional republic apart

Answer: They don’t. At least not constitutionally. The Judicial Branch can issue rulings until they turn blue in the face but they have no ability to enforce them. Enforcement is the purview of the Executive Branch. If the Executive Branch decides that a court ruling is illegal or unconstitutional then it can and should ignore the ruling.

In President Andrew Jackson's time, yes that was the case. Not now. Jackson had the power to fire any executive branch employee who failed to carry out Jackson's orders. With civil service laws in place, the bureaucrats can say "Sorry, have to follow court orders", and ignore Trump's orders.

To hell with congress. These judges need to be arrested for sedition. The damage they’re doing to the rule of law and our republic is beyond imagination.

Consider that the corrupt House left over from the lawless Obama Administration wrongly used it’s unique “power of the purse” (1.7.1) — with the help of the likewise corrupt post-17th Amendment ratification Senate — to make these funds available for such a purpose.

Patriots now need to be making sure that there are plenty of state sovereignty-respecting, Trump-supporting candidates on the 2018 primary ballots, and pink-slip career lawmakers by sending patriot candidate lawmakers to D.C. on election day.

Because Congress permits it. Read Article III, Section II of the Constitution. Second paragraph, second sentence: “In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.”

Congress can reign in the federal courts tomorrow, assuming it wishes to.

Congress is subject to the same division of powers that the courts are.

Congress cannot create constitutional power to bestow upon the courts.

The Commander In Chief is free to disregard both.

I think, at this point, we can do away with the useless Office of the President.

Why spend all the money with the pomp and circumstances and all the money with the Secret Service protections? It’s not like the President can do absolutely anything any more.
