9th Circuit denies wider court review of Trump's travel ban

The 9th Circuit Court of Appeals on Friday denied a request for an 11-member court review of President Trump's travel ban that was struck down by a Hawaii federal judge earlier this year.

According to the Los Angeles Times, the San Francisco-based appeals court voted to reject the request from Hawaii for a wider review that would have taken the case to a full “en banc” panel.

The decision means that the case will now follow a traditional path of judicial appeal, and will head to a three-judge panel next month.

According to the report, the judicial order did not provide any details as to why the request was denied by the court.

Basically, yes.

Leftists are more radical and much more prone to be activists and to get in your face.

Conservatives are more passive, law abiding and reliant on the “system” to solve problems. They don’t rock the boat.

That’s why there’s never a conservative revolution.

Reaping the whirlwind.

Trump has to be only the first step, politically speaking. Patience has to be a hallmark of bringing this nation back to greatness.

The crushing societal perversions rampant in America (I consider the lawlessness of this court one of those perversions) didn’t begin with Obama. Hopefully it peaked then, and we can begin to climb out of these depths of idiocy.

Trump is step one.

One huge caveat: without SPIRITUAL awakening, starting in the church and expanding to society as a whole, we are doomed. Conversion and repentance, available only as God provides and enlightens, is essential. The means by which this is accomplished is humility and prayer practiced by His people. Turning to the Word and fellowship in the local church—showing compassion to our neighbors are also without substitute.

May we engage daily in these practices....

I agree. I think the R’s and D’s have been two sides of the same #umiparty coin. They’ve been playing “good cop, bad cop” with us for decades.

Because that is the way God has ordained it for whatever reason- God said ‘be not surprised’ basically- these things must happen-

Knowing that though doesn’t make it much easier- as moral people are on edge just hoping and praying that true justice will prevail- but the world and the left are exchanging the truth for lies- just as the bible prophesied they would

The situation is baked into the legal process. It takes 100 times more money and effort to reverse an incorrect decision than to make one, and the appellate courts tend to defend their brethren on lower courts, on the principle that the courts can do no wrong.

Exactly. The Judicial Branch has no qualms about overstepping their bounds but Congress has no stomach to even exercise the powers delegated to it.


We often call the GOP the Stupid Party. Maybe what they really are is the Party of Wuss.

I guess in theory he could do that....he would need the Senate to confirm them to be seated....

That would not be very prudent or wise....

Not really sure we want Trump to start acting like a banana republic head of state or set a precedent for future POTUS do the same...

At this point, the 9th Circuit orders need to be ignored.

This is entirely within the purview of both the Executive and Congressional branches. They are separate branches of our federal government and are not obligated to kneel before the Judiciary even though they generally do so.

Ever since Marbury v. Madison, the Congress and Executive have tended to defer to judicial decisions, but they do not have to. Marbury v. Madison was extra-constitutional. I wouldn't go so far as to say unconstitutional because the nation was young and still feeling its way at the time. But there is nothing in the Constitution that explicitly gives the courts the power to stop lawful actions by the other two branches.

The 2008 and 2012 repub presidential campaigns each achieved new highs in the Art of Wuss. The reason so many repubs resisted Trump in 2016 is that he didn’t worship at the Altar of Wuss.

EXACTLY!

They don't want a higher level review because they know they will be rebuked - again.

So if President Trump ignores the ruling they have two choices:

  1. Take no further action and let the president continue to ignore them.

  2. Challenge the president in the Supreme Court, which is what they are trying to avoid.

The republicans don’t have any balls and they like things just the way they are:

Confused
Controlled by special interests that fund their campaigns
Their privilidged status for life
No term limits
A process mired in secrecy and contorted rules
They like cheap illegal labor because their benefactors like it
They like a monster tax code so they can favor friends and punish enemies just like their handlers tell them to do.

The situation is as hopeless today as it was in 1938 when Jimmy Stewrart made “Mr. Smith Goes to Washington” A decent man can’t survive to fight. The system is totally corrupt.

We really have to stop thinking of what is happening in terms of Republican/Democrat or even liberal/conservative. That is a smokescreen. What is really happening is the new Global Economy intellectual elite protecting their economic position against the now forgotten and superfluous former middle class and blue collar working class. It is the elite urban centers supported by their largely immigrant cheap labor (who are in turn supported by tax dollars), people who work cheap to clean things, take care of the elite’s children and serve their meals.

Right and Left are on the same side, and are merely concerned with distributing the wealth from their global “indentured servitude” economy amongst themselves. And keeping the former middle class and working class that is now on the outside cowed by charges of racism as they bring in cheap manual and intellectual labor to take their places in the new economy. Republican and Democrat, liberal and conservative are all on the same team - managing the elite global economy and chasing everyone who doesn’t fit out to the hinterlands. Californication.

The only constitutionally required court is the USSC. The Congress has the constitutional authority to establish an decide the jurisdiction of those courts.
