The 9th Circuit Court of Appeals on Friday denied a request for an 11-member court review of President Trump's travel ban that was struck down by a Hawaii federal judge earlier this year.
According to the Los Angeles Times, the San Francisco-based appeals court voted to reject the request from Hawaii for a wider review that would have taken the case to a full “en banc” panel.
The decision means that the case will now follow a traditional path of judicial appeal, and will head to a three-judge panel next month.
According to the report, the judicial order did not provide any details as to why the request was denied by the court.

They are way out of bounds here and it has to stop.
If Republicans had any balls, they’d defund the 9th Circus. That is the check The Founding Fathers gave the Legislative Branch to rein in the Judicial Branch when it tries to usurp its power.

Now that Gorsuch is in, skip the 9th Circuit and appeal directly to SCOTUS.
The 9th circuit court grandees better be praying there aren’t any atrocities committed by “refugees” from the seven terror states covered in the executive order they’re illegally holding up.
I think it is a positive outcome for the GOP, if I’m reading it correctly. Looks like the Hawaiian judges wanted to stop or delay the appeals process, after an appeal was submitted by Pres. Trump’s attorneys.

In two simple moves, why doesn’t Trump issue an EO to dump the 9th court and appoint all their replacements.

Exactly. The Judicial Branch has no qualms about overstepping their bounds but Congress has no stomach to even exercise the powers delegated to it.
