President Trump Directs White House Counsel to Find FISA Warrants

A senior White House official tells the New York Times that White House counsel, Donald F. McGahn is now searching for a FISA warrant – or series of warrants – allegedly issued in an Obama-era investigation of Donald Trump’s ties to a shifty Russian bank.

The official says that McGahn’s office wants access to any order, issued by the ultra-secretive Foreign Intelligence Surveillance Court, relating to President Trump, his campaign, or his immediate associates.

Those documents are usually only available to law enforcement, and while the White House has the authority to request the documents, they typically don’t – largely because the Department of Justice is supposed to be insulated from political pressure to take on, or complete, an investigation.

Judge Napoleono was just on. He said FISA is a part of judiciary and probably would not just give them up BUT Trump as CiC could easily get them from NSA which is part of the military

AFAIC, the FISA court is a secretive rubber stamp court that doesn’t answer to the US Constitution. It should not exist in my opinion.

The Chief Executive IS the head of law enforcement. He is OVER the Attorney General. It’s the same way he is the commander in chief of the military. The FBI has zero right to withhold any work product from him.
It would be impeachable for a president to use the DOJ to go after someone for personal or political reasons (for example the way Obama did with IRS and FISA courts)
But yes, a president may examine any work product of the executive branch.
He may walk in and open any file cabinet he pleases at the Justice dept or at the CIA. He may land at Area 51 and go anywhere he pleases.

He cannot so much as set the speed limit on a city street. He does not have power over citizens like that. He cannot walk into the Congress, or the Supreme Court and open a drawer. But yes, he is fully head of the executive branch, and that’s how it is kiddies. Nobody in that branch can tell him something is above his pay grade.

The FISA order was for TT which includes the Chinese bank

What are the chances that the Chinese bank would have business with the Russian Bank?

The President does not need to go to the FISA court to get anything. He simply needs to order it produced to him by his subordinates in the executive branch. He is the head of the executive branch and they are required to give him whatever documents he asks for. There is no statutory exception whereby federal bureaucrats get to pick and choose what they give to the president. A president might decide as a matter of policy, that he will not ask for documents concerning an investigation of himself or his associates, but constitutionally he is permitted to ask for and obtain any document in the hands of the executive branch, which includes the DOJ, FBI, NSA, CIA, etc...

But if FBI went in front of FISA court, Trump can instruct DOJ to provide all filings they made with the court. And any ruling FISA made that allowed the FBI to proceed with something...he can have that also.

All I know, it that there is high treason afoot. There is a coup attempt in progress. And I think i’ll just hang onto Mr. 870 a little longer.

(REAGANGENERATION2 HAT TIP)---Trump should be able to review all 2 or 3 FISA requests (if he hasn’t already), and then let Congress determine if the requesters lied about the probable cause justifying them......then (1) you’d prove perjury, and, even worse, (2) b/c the intent was to abuse executive power.

A good beginning....and then it gets downright lethal for the Obama gang:

Via Breitbart, JOHN HAYWARD observed that the FISA court may have approved a warrant submitted without Trump’s name but “which Obama then misused to spy on Trump and many connected to Trump.”

Ergo the most serious legal jeopardy that might be faced would be (a) perjury for lying to the FISA court, and, (b) the dissemination of collected intelligence that should have been kept tightly classified.

It is also entirely possible that Obama and his legal team may have perjured themselves before the FISA court by willfully withholding material information in order to manipulate the FISA court’s willingness to permit the government surveillance.

FALSIFYING GOVT DOCUMENTS would fall under the Crimes Act of 1958. Moreover, falsifying official documents is the criminal MO to hide larger crimes.

EXCERPT A person falsifying documents can be held criminally liable if they are deliberately acting with the intention of deceiving or defrauding another party.

Falsifying documents is a very serious offense and is generally classified as a felony. This means that a person charged with falsifying documents may be subject to the following legal penalties:
◾Having to pay a monetary fine
◾Incarceration in a prison facility

Depending on the gravity of the offense, as well as individual state laws, falsifying documents can result in a prison sentence of 5-10 years.

Also, if official government documents or govt authorities were involved, the legal penalties may be more severe. Legal penalties may increase with repeat offenses.

Many different types of acts can be considered as falsifying a document, including:
◾Altering or misrepresenting fact-based information
◾Stating false information when requested to provide truthful statements
◾Forging a signature
◾Using official letterheads without authorization
◾Knowingly using or distributing a fake document

The penalty for falsifying government documents is outlined in the Crimes Act of 1958.
