Vanity: Can the president ignore the court and continue with his valid executive order?

Vanity Discussion Question: Can the president ignore the court order and continue with his valid executive order?

It appears the president is acting in accordance to his constitutional powers and specifically in accordance to laws regarding immigration and has been challenged and overridden by an unconstitutionally political activist (liberal) court.

If so, can he can he continue with his valid orders controlling the actions of the executive branch? No doubt this would set up a "constitutional crisis" but this is going to happen soon anyway as it's the only way we will ever restore constitutional government, ie, the liberal activist courts will have to be toppled eventually. Why not now while we have a strong president and Republican majorities in both housees of congress?

Just askin'.

I don't think that's true at all. Aliens are often convicted of crimes, incarcerated, and even executed if they commit a crime on US soil. Not trying to apply that to the Trump EO case, just speaking directly to your comment.

As far as the Trump EO case goes, I think the other poster is correct who says that if the law plainly says in black and white that Trump is correct and the court is wrong, he should be able to ignore them and proceed.

If I were the President I wouldn’t ignore the ruling, I would take it quickly to the Supreme Court.

I don’t think it would be 4-4 in the Supreme Court. I think it would probably break something like 6-2 in initial conference and the final vote might even be 8-0 in Trump’s favor.

Remember, Obama got shut down unanimously at the Supreme Court in a number of cases where he clearly exceeded his power. The Supreme Court has examined these questions of presidential power very closely in past cases. This is not a close question, President Trump is clearly within his authority, and since the Justices already have a record on these types of questions, I don’t expect them to replicate what the 9th Circuit panel did.

If he ignores a court decision, the impeachment proceedings will start next week. And most republicans will side with the democrats.

And the tree of liberty will have much nourishment for its roots.

The People have the final say about ALL of this.

Three co-equal branches of government. Seems to me that the courts have exerted too much power without pushback from the other two branches. In my mind Trump can proceed with a lawful order regardless of what the court says.

Congress needs to strip federal court jurisdiction over Executive Orders regarding immigration. They can do this under Article III of the Constitution.

The big problem I see is that the 9th Circus is emboldened by the 4-4 split at SCOTUS. They are used to getting reversed, but feel that will not happen now.>>> you are correct. we should drop this Eo and draft another. otherwise well have a Roe v Wade of immigration. just start up a large paperwork chain for those 7 countries.

The next move is almost certainly to see if Justice Kennedy will put a stop to this nonsense, pending a decision by the Supreme Court.

If the “full” Supreme Court somehow rules against President Trump, THEN we will be in the midst of a full blown constitutional crisis. Perhaps the worst since the Civil War.

It seems highly unlikely we will have a 9 person court in time to rule on this. We already know the Constitution is whatever they want it to be for at least 4 members of the court. What the Constitution actually says is irrelevant to them.

The outcome is most definitely in doubt.

the President (and not the court) not only has the authority to enforce his perfectly=legal order, he has the DUTY to do so

HOWEVER he may wish to...
1. issue a NEW order, which technically would mean he would not be “going against the court order” by what he does next...and
2. his NEW order should find that the national security requires the obvious...and expand the scope and duration of the earlier order

and if the same commie/IslamoNazi cabal challenges the new order in court, DJT should have his lawyers merely file a notice that the courts lack jurisdiction to hear the challenge... and that’s that.

I'm convinced that Trump and Bannon are still playing 3D chess while everyone else is playing checkers.

They knew darn well this would happen. They are just doing reconnaissance. Smoking out the resistance. AB testing.

No way are they going to allow themselves to be humiliated by the courts George Bush style.

They're planning something big, and they are planning to WIN.

I DO think they'll ignore the court, but they'll also have something else going, too.

The bigger question is, what is Trump going to do when SCOTUS rules against him 5-4? Or 5-3 with no confirmation?

What I don't get is how two courts of law could rule against what is plainly stated in the law.

Hey, they rule contrary to the Constitution all the time. This is a mere Feral law. Small potatoes, comparatively speaking.

AG Jeff Sessions is on board now. He provides stability and a lot of smarts for the administration. Trump should obey the courts and simply tell customs agents to do their job with future approvals and get very, very tough from here on.

Another thing is that conflict of interest, with Kelly Conway telling people to buy Ivanka's line. That seems to be a rookie mistake, again showing a need for better legal guidance for the WH. Keeping it real.....Ivanka should have to choose. Since Jared has that WH position and she's moved to DC, it does seem that putting her brand on hold for a few years might be a good thing.

When a court has no jurisdiction, no answer- no appearance in court should occur at all.

Except to notify them of their lack of jurisdiction, in writing.
