NO! They do not. They have only the power that the congress assigns to them.

The courts have no power to grant judgements in favor of aliens; that power has been specifically absent in all of congress’ legislation.

So the constitution assigns the Judicial Branch no power? I guess the constitution doesn’t matter in your book.

From Article III.

The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—

As you can see it clearly says the Laws of the United States.

Neither The statutes under which Trump’s ban has been written, nor the constitution, assign to the courts any power to grant any tort to an alien.

I would estimate 3 months at a minimum. It depends how long it takes the GOP to invoke the nuclear option, because I just don’t think enough Dems will vote for cloture

Just invoke a clause of Rule 19...Senators can only speak twice on a given subject during an open debate....so 48 hours would suffice.

And Rule 19 was invoked last week to gag the faux-Pocahontas
