Republicans push bill to split up ‘nutty 9th Circuit’
Fox News ^ | 02/09/17 | Barnini Chakraborty

As judges on the 9th Circuit Court of Appeals weigh the legality of President Trump’s immigration executive order, a Republican push to split up the controversial court -- and shrink its clout -- is gaining steam on Capitol Hill.

Republican Sens. Jeff Flake and John McCain of Arizona introduced legislation last month to carve six states out of the San Francisco-based court circuit and create a brand new 12th Circuit.

They argue that the 9th is too big, too liberal and too slow resolving cases. If they succeed, only California, Oregon, Hawaii and two island districts would remain in the 9th's judicial fiefdom.

Right now, Flake said, the circuit is far too sprawling.  “It represents 20 percent of the population -- and 40 percent of the land mass is in that jurisdiction. It’s just too big,” Flake told Fox News on Wednesday. “We have a bedrock principle of swift justice and if you live in Arizona or anywhere in the 9th Circuit, you just don’t have it.”

Flake says it typically takes the court 15 months to hand down a decision. “It’s far too long,” he added.

Conservatives have mocked the 9th Circuit for years, often calling it the “Nutty 9th” or the “9th Circus,” in part because so many of its rulings have been overturned by the U.S. Supreme Court.

Under Flake’s bill, the new circuit would cover Nevada, Washington, Idaho, Montana, Arizona and Alaska, leaving the 9th with three Pacific states as well as the Northern Mariana Islands and Guam.

A separate House version introduced by Rep. Andy Biggs and four other Arizona Republicans would leave Washington state in the 9th Circuit.

Stupid crap like this is why federal judges should not have life time appointments.

For sure Republicans had better be using this period of power to replace as many as possible of these arrogant “the law is what I want to be according to my infallible view of the world” judges who now infest the legal system at all levels with solid strict-constructionists who interpret the law according to how it was written, not how they think it should have been written.....

While they are at it, fire the judges and replace them with someone who can read and follow the law.

The left, through these radical judges, is trying to save the future of statist liberalism by continuing to allow the flood of illegals and immigrants in to this country for future votes, while completely ignoring the security nature of the situation.

It’s a power grab in more ways than one. That’s what it comes down to and Congress needs to do something about this ASAP. This proposal is a good start and they need to follow through.

““If the Supreme Court wasn’t going to overturn lower courts’ decisions, then we don’t need a Supreme Court anymore,” Lestingi argued.”

Idiotic liberal logic if ever I read it.

Not only that but move them into a decrepit federal building with no windows and bare cement walls. Good enough for military, good enough for those robed bastards.

Hard to believe Flake and McCain are sponsoring this...

The absolute LAST two I’d expect, although it is their fiefdom.

McCain & Flake are only sponsoring the bill to bring the new circuit to AZ... I propose the 9th be split into a northern circuit and southern circuit with the northern circuit located in Rexburg, ID, and the southern in Mexicali, CA, just south of the new border wall.

Best thing McCain has done since making Palin a national political figure. Glad to see he has not completely sold out to the left.

When you add up the size, the slowness and the end result that they are the most overturned court, it only make sense to reduce their impact and create a new circuit court that can effectively handle a significant portion of the case load.

Like when a business grows to the point where they need to open a second location to better serve the customers, this circuit split is needed to better serve the plaintiffs and defendants - and thus the citizenry at large.

fire the judges

I don't think you can "fire" them, but you can impeach them.

(of course you could always fire at them)
