Appeals Court Denies Justice Department's Motion to Lift Travel Ban Restraining Order By DEAN SCHABNER DAVID CAPLAN Feb 5, 2017 The U.S. Court of Appeals for the 9th Circuit announced early Sunday morning that it has denied the Department of Justice's emergency motion -- filed late Saturday -- to issue an immediate stay on a Washington State judge's temporary restraining order of President Donald Trump's controversial travel ban.

"The court has received appellants' emergency motion (Docket Entry No. 14)," read the order from the appeals court. "Appellants' request for an immediate administrative stay pending full consideration of the emergency motion for a stay pending appeal is denied."

Lawyers from Washington State and Minnesota, who brought the challenge to court in Seattle, have until Sunday at 11:59 p.m. Pacific Time to file a response to the Department of Justice's request. The Justice Department then has until Monday 3 p.m. Pacific Time to file a reply brief.

Lawyers for the Department of Justice argued in the filing that the restraining order is "vastly overboard," and it "second-guesses" the commander in chief.

A president can’t remove judges from their positions. Why the hell do you even ask that? The House can impeach and the Senate convict, but that will never happen.

This is the 9th Circus Court of Appeals. They cover Frisco and Berkely, and other nutso enclaves, and have a reputation to uphold as a politically biased, kangaroo court.

What is the U.S. judiciary going to do if the U.S. Dept. of Homeland Security simply keeps every traveler from those seven countries out of the U.S. — or just delays their entry indefinitely for some reason or another?

Are we and have we been under a judicial dictatorship for quite a long time and just didn’t know it? Maybe it is not a bad thing for people to realize what is going on here. This is not about keeping us safe. This is about hatred for Trump and all of the things which have been hidden from the American people for a long time which might be made visible through this Trump administration. This is bad, bad, bad.

If anyone dies from a terror attack because of these judges, then the judges need to be held criminally liable.

They are enabling the terrorist to attack. They are endangering the public to another September 11th attack.

This is NOT acceptable and these globalist judges must be removed for public safety.

Trumps most urgent priority needs to be getting his cabinet in place
Then let them take on the tasks and the heat for some of these actions
If his delay in immigration is to develop stronger vetting procedures, then get an Attorney General in place, let him get his department cleaned out and organized let Sessions and Kelly work out vetting procedures, then implement them

Trump is too fast out of the gate on his own on too many fronts !!!!

I would think a CEO knows more about delegating

Right. Basically there is no hope, is there? There is no way to win legally since the courts are stacked against us.

Which brings me to another question. Why do all the really important questions land in the 9th court?? It’s almost like it’s prearranged.

Funny how Putin and Xi Jinping don't have problems like this with their Judiciary, Press, or protesters.

Must be that whole, "I'm scared of being summarily executed" thing that works so effectively.
