Statement by the Press Secretary:
At the earliest possible time, the Department of Justice intends to file an emergency stay of this order and defend the executive order of the President, which we believe is lawful and appropriate. The president’s order is intended to protect the homeland and he has the constitutional authority and responsibility to protect the American people.
As the law states, "Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate."

If they do not strike this judges ruling, the Trump administration will ask for an immediate emergency stay, which Kennedy will most certainly grant. He will conclude that in his opinion, on the merits, that the executive branch has the inherent authority to manage immigration issues. He will allow Trumps order to remain while the sides prepare to argue the case in front of the full court.
On this one, I do not think even the USSC will oppose the presidents authority. If Gorsuch isn’t on the court... 5-3 ruling. Maybe 6-2. Sotamayor and Ginsberg will rule against him no matter what happens. Breyer might join the rest. Or he might stick with the old lady and La Raza judge.
There may come a time very soon, when Trump needs to broach the subject of impeachment for judges who issue court orders that have absolutely no Constitutional or statutory basis.
Why do we even have elections if we allow judges to rule against the constitution? I thought the three branches of government were supposed to be insurance against tyranny, yet for decades the judicial branch has, in many cases, been just that.
