The Filibuster in the Era of Trump

The filibuster may seem a weapon of obstruction in the hands of Senator Schumer, but the Minority Leader may find himself in a trap of his own making when he uses it. During the Obama years, Republicans campaigned on the promise that "If we control the Senate and the House, we will pass conservative laws to rein in a lawless Obama administration." But after each election Senate Majority Leader McConnell said that that it was almost impossible to get anything done because the Democrats blocked every meaningful action in the Senate. Does that really mean that we have to elect the very rare filibuster-proof majority to slay the governmental leviathan that has been built over the last century?

Even now, with Republicans controlling both houses of Congress and Donald Trump moving into the White House, they throw out this same excuse: "You can't pass anything in the Senate without sixty votes." Are our political leaders lying? Were their pleas simply a way to convince us that we should vote for them, even though we may find them doing nothing again? Put another way, "Is the fix in, and we are permanent patsies?"

When Senator Scott Brown was elected in 2010, he was thought to be the final filibusterer to prevent ObamaCare from being voted on in the Senate. It was the classic position of the minority: Let's prevent the majority from running roughshod over "the will of the people." But the Democrats got around the filibuster and the rest is history. And it seems that the new Republican Congress will use basically the same tactic to eliminate ObamaCare. But what about other legislation?

The real crux of the matters about real filibusters versus threatened filibusters is one of determination. Republican RINOs always conceded at the ‘threat of one’ while Democrats said ‘bring it on.’

It is time we reversed the roles, destroyed their rules in the Senate (that have no Constitutional dictate to adhere to). Those decisions that require 2/3 majority are stipulated succinctly - all others are plurality.

IOW, make them put up and follow-through or STFU or just change whatever bullcrap rules these senators have schemed for.

We already had the Reid Rule. Time for the Nuclear Option. This means you McConnell! There is really no reason to hold back - when Democrats are in power they are going to do what Democrats do. Think Prisoners’s Dilemma in game theory. We’ve never pushed back or punished the RATS when they don’t cooperate. Time to change that.

Anyone who has taken to the time to study President Donald John Trump knows that he is a man who is unafraid of a challenge.

The democrats in the senate along with a few RINOs continually challenge the President by attacking his nominees.

President Trump has nominated Gov Rick Perry to head and rein in the dept of energy, certain buffons in the Senate are acting like the fools they are. Likewise with Mrs. DeVoss as head of the dept of education and Rex Tillerson.

Now let's look at reality folks, something the democrats are unwilling and/or are incapable of doing.

As for hindering Gov. Perry for secretary of energy and Mrs. DeVoss to head the infamous failure, the department of education. The choice is clear confirm the nominees and have a streamlined, revamped, less dangerous department or have no department at all.

Concerning the Department of State and Rex Tillerson's appointment, fail to appoint and President Trump will be his own Secretary of State.

The article is spot on. Make the Dems stay awake and talking 24/7 if they want to filibuster. No bathroom breaks, no rest breaks. Stand and talk as long as they and the American people can stand it. Meanwhile, McConnell, the GOP Senate leadership, and the President should be on television and social media deploring the Democrats obstructing the will of the people.

This is war. Fight fire with fire.

For all intents and purposes, the “super” majority is a contrivance of the senate not the Constitution. Republicans have never blocked objectionable supreme court justices. The republicans have always rationalized their votes by saying that the president should be able to pick who he wants on the court. That flawed thinking has resulted in really bad judges such as ginsburg, sotomayer and kagan. Any hint of democratic obstruction should result in the implementation of a simple majority vote requirement for supreme court justices.

The filibuster may have been intended at keeping a slim majority in the U.S. Senate from making dramatic changes in Washington, but those days are long gone.

The filibuster's only purpose right now is to give the party with a slim majority -- especially in the case of the GOP -- an excuse not to do their jobs.

They ought to get a supermajority requirement (60%, 2/3rds, etc.) written into the U.S. Constitution, or ditch the thing forever.

Filibusters need to be real “Mr. Smith Goes to Washington” type filibusters, not the pretend ones they allow now.
