Undocumented worker sues San Francisco for violating sanctuary law

(Reuters) - An undocumented immigrant from El Salvador is suing San Francisco alleging police violated the city's sanctuary city policy by turning him over to U.S. immigration authorities after he reported his car stolen.

The lawsuit was filed on Tuesday on behalf of Pedro Figueroa Zarceno, 32, in federal court in San Francisco against the city and its police chief for violating his right to due process and breaking an ordinance barring municipal employees from cooperating with federal immigration authorities seeking to deport a person.

Figueroa walked into a police station in November 2015 to report his car stolen, according to the lawsuit. Two days later, the car was found and when he went to recover it, he was handcuffed and led outside where federal immigration agents were waiting for him, the lawsuit said.

The civil action comes as San Francisco and dozens of other U.S. cities face pressure from President-elect Donald Trump, who takes office on Friday, to abandon their policies of limiting cooperation between law enforcement officers and U.S. immigration authorities.

Throw out the lawsuit and deport the illegal alien.
He should have been deported years ago.

How can a city government nullify federal law?????

Couldn’t a Texas city nullify EPA regs and Tax laws to make a city great again? NOPE.... Lib-double standards...

Throw out the lawsuit and deport the illegal alien. He should have been deported years ago.

I'm sure this won't be the first time this guy was deported.

NEVER get into a conversation with the Devil! Yet, as we know, the Left chats with him all day and he gives them high-minded, self-righteous ideas to play with.

“Sanctuary Cities” has his customary sheep’s clothing, but here Pedro shows the wolf underneath, looking for MORE to devour, MORE expansion of the original foothold, MORE ingratitude masquerading as legitimate plaint.

Of course Yahoo & Reuters conceal the fact that he was not just an "illegal alien" but he already had both an order of deportation from 2005 and criminal conviction from 2012.

As a gruff old Freeper schooled me once, “The Constitution and our laws apply to everybody equally.” Some leftists and many government officials disagree with that statement, and they over step their bounds. Also, many of them don’t understand the concept of “sovereignty” at both the state and Federal level. Finally, many politicians don’t have the guts to stand up and tell people they are wrong, even on the most important of issues. Hence we have an illegal immigrant, suing a city over an unconstitutional “law”.

I think San Francisco is trying to set up a test case that it can win in both the court of public opinion and in the lower district courts . the idea is to build up case law in the lower court so that when the city goes after Trump for taking away funding in the supreme court it will have a bunch of cases in the ninth district court supporting the city regulation of non corporation.

Interesting situation. I wonder if this litigation will stop all of the sanctuary city nonsense. I mean if it succeeds, it could get pretty expensive for sanctuary cities.

Oh, course the result of the litigation will likely be much like the police duty to protect. It doesn't really exist as you can't rely upon a City's police force to protect you. I would wager you can't rely upon a City's civil employees to shield you from federal deportation laws.

Hmm. Maybe once that becomes know, illegal aliens will no longer trust sanctuary cities to protect them.

Sounds like the litigation will be a win-win for the public

I wonder if filing this federal lawsuit delays the plaintiff’s deportation? Regardless, the schadenfreude in this is sweet and goes well with my morning coffee.
