Last week, California legislature passed AB 1798 last week. On Friday, Governor Brown signed it into law. Under the new law any object that would lead a reasonable person to perceive that the device is a firearm is now verboten. Given that the Golden State is home to some extremely unreasonable people, one wonders if a Pop Tart chewed into the shape of a gun would qualify. This is how the new law reads:
Firearms: imitation firearms: gun-shaped phone cases.
Existing federal law prohibits a person from manufacturing, entering into commerce, shipping, transporting, or receiving any toy, look-alike, or imitation firearm unless the firearm contains, or has affixed to it, a marking approved by the federal Secretary of Commerce.
Existing state law defines imitation firearm as any BB device, toy gun, replica of a firearm, or other device that is so substantially similar in coloration and overall appearance to an existing firearm as to lead a reasonable person to perceive that the device is a firearm.
Under existing law, a manufacturer, importer, or distributor of imitation firearms that, among other things, fails to comply with any applicable federal law or regulation governing the marking of a toy, look-alike, or imitation firearm, as defined by federal law or regulation, is guilty of a misdemeanor.
This bill would specify that the definition of imitation firearm described above includes, but is not limited to, a protective case for a cellular telephone that is so substantially similar in coloration and overall appearance to an existing firearm as to lead a reasonable person to perceive that the device is a firearm.
How is this not an Any-Other-Weapon??!?
“Any other weapon” is a “catch-all” category. An AOW as defined as “any weapon or device capable of being concealed on the person from which a shot can be discharged through the energy of an explosive,” other than a handgun with a rifled barrel”.[3] This umbrella definition includes many improvised firearms (”zip guns”) and disguised firearms. Examples include wallet guns, cane guns, knife guns and pen guns.[19] An AOW can be transferred to non-prohibited persons with a $5 BATF stamp as opposed to the $200 stamp required for machine guns and short-barreled rifles.”
The best gun is the one close at hand. This Derringer is not ideal, but it is better than nothing. It could kill; the problem is it may take a while, and the perp I’d going to be pissed off when he reaches the victim.

Laser sights tend to be fairly accurate, as long as the weapon is not abused.
So now, when they break into your place, convinced that you are a bad guy, and you’re not, and they have the wrong place, and you reach for your smartphone, you get shot?

The woman was killed even though she was carrying a concealed 9 mm fire arm. The two shot, laser aimed gun was disguised as an I Phone. The officer investigating her death said witnesses told him that on realizing the danger, she drew the gun but was distracted by the seeming need to reply to a text message displayed thereon
